Assignment of shares by Thomas Goldney II to his son Thomas Goldney III

This indenture Made the Twentieth day of March in the fourth year of the reigne of George by the Grace of God of Great Britaine France and Ireland King Defender of the Faith etc Annoq[ue] Domi[ni] 1717. Between Thomas Goldney the Elder of the City of Bristol Merchant of the one part and Thomas Goldney the Younger (Son of the said Thomas Goldney the Elder) of the other part Witnesseth that for and in Considerac[i]on of the Natural Love and Affection which the said Thomas Goldney the Elder hath to and for the said Thomas Goldney the Younger his son and for the better advancing of his said son in the world And for five shillings of lawful mony of Great Britain to the said Thomas Goldney the Elder paid by the said Thomas Goldney the Younger before the Ensealing and Delivery of these presents (the receipt whereof is hereby acknowledged) and for divers other good Causes and Considerac[i]ons He the said Thomas Goldney hath Bargained and Sold Assigned and sett over And by these presents doth Bargain and Sell Assign and Sett over Unto the Said Thomas Goldney the Younger Two Full Sixteenth parts and shares of and in all Benefit of and by a certain Patent sometime since granted by the Crown to Abraham Darby late of Colebrooke-Dale within the parish of Maidley in the County of Salop Iron-Master, but since dece[a]s[ed] or to some in Trust for him for Fourteen Years (Severall of which remain unexpired) for the Casting and Making Iron Potts and other Iron Wares in Sand And also Two Full sixteenth parts and shares of and in the Work Trade and Business of Casting and Making Iron Potts and other Iron Wares at certain Work houses or a Workhouse at Colebrooke Dale aforesaid And of and in all the wares and Goods Made and to be Made in or by the Said Work and Trade And of and in all Debts and Monyes belonging thereto (Except such Debts and Monyes as are now Standing out and due to the said Trade and were so before the fourteenth day of May last past before the day of the date of these presents) And of and in All the Utensils and things of and belonging to the said work and business And also Two Full Sixteenth parts and shares of and in All these Workhouses and Workhouse and of and in all Buildings, Furnaces and Forges with th[e ]appurtenances and Utensils and things annexed or belonging unto the said workhouses and workhouse and buildings And also of and in a Certain Indenture of Lease that was in or about
December one thousand seven hundred and sixteen taken thereof from the Earl of Scarborough, M[aste]r Sheldon and M[aste]r Gower And of and in all the Interest and benefit thereof And of and in all and every other Lease and Leases and Interest and Interests which the said Thomas Goldney th[e ]elder now hath of and in the said workhouses, Buildings, Furnaces and Forges or Forge. To have and to hold the said two sixteenth parts and shares of and in all the benefit of the said Patent Unto the said Thomas Goldney the Younger his Executors Administrators and Assigns from henceforth for and during all the Remainder of time that is now to come in and under such Patent And To have and to hold the said two sixteenth parts and shares of and in the said work and business of Casting and Making Iron Potts and Wares and in the said Wares Goods Utensils and things unto the said Thomas Goldney the Younger his Executors Administrators and Assigns from henceforth for and as his and their own proper Goods and Chattles forever And To have and to hold the said two sixteenth parts and shares of and in all the said Workhouses, Buildings, Furnaces and Forges with th[e ]appurtenances Unto the Said Thomas Goldney the Younger his Executors Administrators and assigns for and during the term granted in and by the said Indenture of Lease and for and during all such other Terms and Interests and Interest as the Said Thomas Goldney the Elder now hath therein Subject by way of Agreement to the Paying and Performing in Conjunction and proporc[i]onably with the said Thomas Goldney the Elder Mary Darby widow of the said Abraham Darby and John Chamberlaine of Stow in the Wold in the County of Glouc[este]r
Esqu[ire] their Executors, Administrators and Assigns of the Rent and Conveyants in the said Indenture of Lease reserved and contained on the Lessees part to be paid and performed. And the said Thomas Goldney the Elder for himself his Executors and Administrators Doth Covenant with the said Thomas Goldney the Younger his Executors and Administrators that it shall and may be lawful to and for the said
Thomas Goldney the Younger his Executors Administrators and Assigns (paying and performing proporc[i]onably as aforesaid the said Rent and Covenants) peaceably and quietly to have, hold, receive, take, and enjoy to his and their own proper use and behoofe according to his tenor and true meaning of these presents the said two Sixteenth parts and shares of and in the premises and of and in the profits and proceed thereof without any Lett Suit or Denyal whatsoever of or by the Said Thomas Goldney the Elder his Executors or Administrators or of or by any other person or persons whatsoever lawfully Claiming or to Claim by from or under him
them or any or either of them. In Witness whereof The partyes firstabovenamed, have, to these present Indentures Interchaneably Sett their hands and Seals the day and year
