(Copy) Thomas Lloyd of Osbaston in the parish of Kinnerley 2. James Thomson of Lightmoor of the parish of Madeley

 

Whereas Lloyd and William Ridding of Ironbridge in the parish of Madeley gentleman as his surety by their bond dated 1 July 1830 became jointly bound to James Thomson in the penal sum of £3000 to be void on repayment of the sum of £1500 with 5% interest.

 

Also Lloyd executed a warrant of attorney on 25 January 1831 authorising attornies to appear for him in a court of the King's Bench in the Hilary Term and receive a declaration for him in an action of debt for £3000 borrowed at the suit of James Thomson and there to confess the same Action or to suffer a judgement of Nil dicit to be entered up against him of record, upon which warrant was endorsed a defeazance that the same was given for securing the payment to Thomson £1500 and interest on 1 April next. Lloyd is unable to pay off this and it is now agreed that for the further better securing of this the manor shall be conveyed upon trust

 

Now in consideration of 5/- Lloyd releases to Thomson the Manor situated in the parish of Westbury; all his messuages at Osbaston in the parish of Kinnerley and Maesbury in the parish of Oswestry and a messuage in Rurgedin and Varchoel in the parish of Guilsfield together with all appurtenances pastures commons, common of turbary etc and all Lloyd's property in the parishes of Westbury, Kinnerley, Oswestry and Guilsfield save a certain messuage purchased by Lloyd from Richard Birch sen. and jun. to be held to the use of Thomson, the manor in the parish of Westbury subject to the yearly rent charges payable to the minister of Ministerley and a lease and release of 28 & 29 1827, and 5 & 6 February 1830 and £4000 secured by Edward Brown by way of collateral security with a messuage situate at Osbaston called the Rolly purchased from Richard Brown the elder and younger and intended to be exempted from the present indenture and subject also to a lease and release of 3 & 4 August 1827 between 1. Thomas Lloyd 2. John Onions, William Cooper and Hugh Hughes 3. Joseph Jones Griffiths and Hannah his wife 4. Richard Edwards and Robert Pickering 5. Ambrose Lace and the principal of £8000 due in respect thereof; and also subject to indentures of 1 & 2 May 1829 1. Thomas Lloyd 2. Rice Wynn and the principal sum of £3000 also subject to the indenture of 8 & 9 February 1830 between 1. Peter Ellesmere and John William Watson 2. George Morgan; and the principal sum of £800; also subject to indentures bearing date 25 & 26 February 1830 between Thomas Lloyd and Richard Taylor and the principal sum of £2400 and all interest due on a collateral security a farm in Burgodin and Varchoel in the parish of Guilsford subject to another indenture of mortgage made between Thomas Lloyd and William Cooper and to the principal sum of £200; and subject to an indenture of mortgage made between Thomas Lloyd and William Cooper and to the principal sum of £200; and subject to an indenture of mortgage of 16 December 1826 between Thomas Lloyd and 2. James Pinches and Samuel Perkins and the principal sum of £700, and also subject to the sum of £2400 secured to the said Richard Taylor; and subject to a certain indenture of lease and release (no date given) between Thomas Lloyd and William Windsor and the principal sum of £600; and also subject to the following trusts i.e. that James Thomson as soon as convenient shall convey all the aforementioned properties to persons willing to become their purchasers and upon trust that out of them Thomson shall satisfy all the costs of such sale, and discharge the mortgages upon the properties and the residue, if any, be given to Thomas Lloyd.

 

Lloyd promises that he will pay Thomson the sum of £1500 hereby secured with interest at the rate of 5%.
