Whereby, having recited:- firstly, that H. Barber made her will on 8th Nov., 1928, appointing W.N. and E.M. Barber (described in 1938 as in 353/16/14) her trustees; secondly, that H. Barber died on 12th Jan., 1936, her will being proved at Birmingham on 30th Dec. that year (supplementarily to a mortgage (dated 31st. Dec., 1924) made between herself of the first, herself and W.N. Barber of the second, and Lloyds Bank Ltd. of the third, parts); and thirdly, the satisfaction of all moneys: therefore, in consideration of the premises, the Bank surrenders the hereditaments (as empowered by the 1924 deed) to W.N. and E.M. Barber as mortgagors.
