Description:

(Made on a Ministry of Transport form) whereby, firstly, J. Smith and M.K. Jude (described as in PA 350/10/3) agree to sell to the Ministry of Transport, for £150, property described in the first schedule (viz. 550 sq. yd. as shown on PA 353/10/2); secondly, the purchase-money will be paid at Orton's offices within 7 weeks (with 4% p.a. interest if unpaid); thirdly, the vendors will pay former tenants' compensation-claims; fourthly, within seven days the vendors will furnish the purchaser with a copy of title to the premises; fifthly, the vendors will execute a proper conveyance; sixthly, at request, the vendor shall join the Ministry in obtaining the apportionment of any outgoings other than land-tax; seventhly, the land is sold subject to the second schedule's provisions (viz. that the purchaser (a) erect a stock-fence, (b) raise on the north side of the vendor's adjacent land a fence similar to that in situ, replacing the hedge, and maintain it for two years, (c) re-erect and re-connect a water-tank, in a position approved by the vendors, (d) re-instal the tenants' cattle-pen); eighthly, the vendors will convert adjoining land into approachways by application to the relevant highway authority; ninthly, the vendors will release to the purchaser all pre-emption rights; tenthly, the purchase-money shall include compensation for the vendors' and mortgagees' claims; eleventhly, the purchaser will pay the vendors' solicitors and surveyor (Mr. Edgar Wnittendale) fees of 2 gn. and 6 gn. respectively; twelfthly, insofar as this agreement is deficient, nothing herein shall prevent the Ministry's exercise of powers given by Orders in Council or statute; thirteenthly, this agreement remains valid for anything not covered by the intended assurance; fourteenthly, no stamp duty is payable, and fifteenthly, the terms "the vendor" and "the purchaser" include their successors in title.
