Description:

Probate of the will and Codicil of William Seward Wood of the Whitehouse.

 

By indentures William wood of the Whitehouse esq., and Frances his wife (1) and Richard Colloe of the city of Hereford (2) by fine levied, and by deed poll of 7 August 1827, the Whitehouse estate was vested in Richard Colloe in trust for W. S. Wood for life and then for his children on his marriage with Mary Ann Hardwick, he charged the manor and estate of Whitehouse case she should survive him with £100 p.a., during her life as jointure.

 

He has three children, all under age, viz. Herbert Howorth Wood, Marianne Elizabeth Wood, and Sarah Frances Wood.

 

He now appoints the Whitehouse estate which derives to him from his mother upon trust for his friends the Rev. John Venn, vicar of St. Peter's in Hereford, Henry Jones Jenkins of Madley, surgeon, and William Humfrys of Hereford for a term of 500 years upon trust for his son Herbert Howorth Wood and his issue, and in default such issue or of other male issue of the testator, then for his daughters in equal shares as tenants in common.

 

His father had charged the Whitehouse estates with £8000 payable to trustees on behalf of the testator's six sisters, viz. Ann Seward Wood who married Richard Thomas Barra, Emmaline the wife of the Rev. Morgan Jones, clerk, Mary Wood, Frances Sarah Wood, Elizabeth Caroline Wood, and Herberta Magdalen Wood, who has since married Henry Jones Jenkins. The sum has been fully paid off.

 

To his trustees his moiety of the Dolward estate in the parishes of Saint Margaret's, Turnaston and Vowchurch which he some time ago purchased of Mr. Thomas Davies, and the several pieces of land purchased of Mr. James Watkins situated near the Gilva in St. Margaret's parish, and messuages in Saint Dunstan's, Stepney, let by his father upon a building lease to - Parker at a reserved rent of £12, and all his other real estate Upon trust for his son Herbert Howorth Wood.

 

To his wife Mary Ann, £200 "that she may not be inconvenienced for money before the receipt of her own income..." and to her also any carriage, harness and carriage horses he may have, and all goods, plate, linen etc., derived from her or her family.

 

His wife's estate is at her own disposal, but he requests that she will thereout provide for the younger children, and relying also upon the kindness and natural affection of his sisters, their dear aunts, he now gives only to his dear eldest daughter Marianne Elizabeth Wood a chased gold ring given him by her grandmother Hardwick and 20 guineas to purchase a gold watch or any other trinket she may choose. To his youngest daughter Sarah Frances Wood the plain gold massive ring once the property of his mother and inscribed "Where Love is God is" and 20 guineas for the same purpose as her sister's.

 

To his trustees all his other personal estate (books, pictures, etc.)., in the Whitehouse upon trust to be used with the Whitehouse as Heirlooms. The residue of his personal estate including moneys in stocks and shares upon the same trusts as his real estate.

 

He appoints his wife executrix.

 

23 August, 1850.

 

Codicil.

 

By his will he made William Humfrys solr., and Henry Jones Jenkins, executors.

 

His son has now attained his majority. He therefore revokes the former appointment and appoints his son sole executor.

 

24 June, 1857.

 

(N.B. He had appointed his wife executrix ?).

 

Declaration of Mary Ann Wood and Herbert Howorth Wood (persons to probate), William Seward Wood having died 11 April 1862 at Alstone Hill.
