Can I please make a request under the Freedom of Information Act and I would like to request the following information with regards to the organisation’s Local Area Network (LAN) environment.

Please can you send me the organisation’s Local Area Network (LAN) contract, which may include the following:

  • Support and Maintenance- e.g. switches, router, software etc
  • Managed
  • Installation
  • Cabling
  1. Existing Supplier: Who is the current supplier for each contract?
  1. Annual Average Spend for Supplier: What is the annual average spending on the supplier above? If there is more than one supplier please split the annual averages spend for each supplier.
  1. Number of Users: Please can you provide me with the number of users each contract covers. Approximate number of users will also be acceptable.
  1. Number of Sites: The number of sites where equipment is supported by these contract.
  1. Contract Type: For each contract is the contract Managed, Maintenance, Installation, Software
  1. Hardware Brand: What is the hardware brand of the LAN equipment?
  1. Contract Description: Please provide me with a brief description of the overall contract.
  1. Contract Duration: What is the duration of the contract is and can you please also include any extensions this may include for each contract.
  1. Contract Expiry Date: When does the contract expire for each contract?
  1. Contract Review Date: When will the organisation is planning to review the contract?

 Section 40(2): Personal Information where the applicant is not the data subject

Section 40 exempts personal information about a ‘third party’ (someone other than the requester), if revealing it would breach the terms of the Data Protection Act (DPA) 1998. The DPA prevents personal information from release if it would be unfair or at odds with the reason why it was collected, or where the subject had officially served notice that releasing it would cause them damage or distress.

To release direct contact details for staff, regardless of their grade, would be to provide a direct route of contact for the relevant individuals which would be likely to lead to a marked increase in speculative enquiries being forwarded to them. This in turn would prevent the individual concerned from being able to operate across the wider requirements of their job role appropriately, which we consider to be unfair. The ‘fairness’ of release of this information must consider the balance between any legitimate public interest in disclosure and the rights and freedoms of the employees concerned. There is nothing of value which would be gained from the release of the direct contact details of these individuals. This information would not increase understanding of the information provided in response to the original FOIA request, or provide further insight into the way the organizations operate.

The National Archives has to observe our obligations to these living individuals and their rights under the Data Protection Act.  The rights and interests of these individuals may be impacted by this release, to the extent that release would be unfair. There is a legitimate interest in favour of non-disclosure to protect personal data of someone who is still living, where that release would breach the first principle of the Data Protection Act. In our view the release of that information would contravene the first data protection principle which provides that personal data must be processed fairly and lawfully.
