Marriage Agreement

 

(1) Sir Walter Giffard

 

(2) Sir William de Wydeworthi

 

Walter Giffard agrees to give his daughter Emma to Hugh, son of William de Wydeworthi, as wife, and all his land in Cornwall which is of the inheritance of the mother of the said Emma in free marriage; if this does not amount to £10 worth, he will supplement it from his land of Didesham. The rest of the land which he has through the mother of said Emma he will not alienate or diminish in any way by which it may be prevented from descending to Emma. William de Wydeworthi will give all his land of Todeworthi to Emma, and he is bound to defend and warrant it at his own expense, and if he cannot he will give her £10 worth of land in his manor of Levestelegh, on these conditions:

 

If Hugh or the heirs of his flesh and of Emma's die, all the said land shall remain to Emma for her life, as dower; and after William's death she shall have the rest of his land, it having been granted to her as contingent dower. Both parties promise that this convention shall be kept faithfully and without deceit, and for greater security, and at their common charges, that it shall be made into a cyrograph in the king's court. And if any of the forenamed break the agreement in any way, he shall be bound to the other in £100.

 

Witnesses: Sir John de Alba Mara, Sir William de Ferar', Alexander de Hemnerdon, William Probo, Richard de Mewy, Herbert de Spineto.

 

Date (given at beginning of document): 38th year of King Henry son of King John, Sunday next before the feast of the apostles Simon and Jude.

 

Seal: missing.

 

'Didesham' may be 'Dittisham' in the parish of Walkhampton, or it may be the parish of Dittisham. 'Levestelegh' is probably 'Lustleigh', and 'Todeworthi' 'Tottiford' in Hennock.
