Between JEREMIAH BENTHAM of Aldgate, London, gent. and GEORGE WOODWARD GROVE of Chancery Lane, co. Middlesex, gent. (1) JOHN CARYLL of Lady Holt, esq. (2) THOMAS DURNFORD of Harting, doctor of divinity, (3) and SIR MATTHEW FETHERSTON HAUGH, baronet, (4)

 

Whereby, after reciting that William Trevanion of Kerhays, Cornwall, esq. the eldest son and heir of John Trevanion late of the same place, esq. deceased, was seized in trust for John Caryll of the Advowson of the rectory of the parish of Harting and the said John Caryll being indebted to the said George Woodward Grove and Thomas Peace of Petersfield, gent. in £200 each procured the said William Trevanion to convey the said Advowson to them upon trust for sale

 

And reciting that the said Thomas Durnford agreed with the said Thomas Peace to purchase the Advowson for £500, to which John Caryll assented and received of the said Thomas Durnford in part of the said purchase money £100

 

And reciting agreement of 30 October, 1751 (No. SAS-K/501)

 

And conveyance of 19 February, 1752 (No. SAS-K/507)

 

The said George Woodward Grove did not execute the said Agreement and Deed, but refused to do so and to receive of the said Thomas Durnford the said £200 and with the consent of John Caryll and Thomas Peace entered into agreement with the said Jeremiah Bentham to sell the said Advowson for the sum of £500 and by deed of 18 November, 1751 (No. SAS-K/544) George Woodward Grove and Thomas Peace conveyed the said Advowson to the said Jeremiah Bentham and the said Thomas Peace not executing the deed the said George Woodward Grove by another deed of the same date conveyed to the said Jeremiah Bentham - for £250 - one moiety of the said Advowson (No. SAS-K/545)

 

Disputes had arisen and suits in Chancery were commenced and, 9 November, 1753, the Lord Chancellor declared that the Agreement between John Caryll and Thomas Durnford for the purchase of the said rectory and advowson ought to be performed and the said Grove and Peace to be considered only as trustees and agents in the Sale and ordered the said Grove and Bentham to convey to Durnford, he paying to Bentham £200 in respect of the £250 paid by the latter

 

And reciting that Durnford's name was used in trust only for Sir Matthew Fetherstonhaugh

 

It was witnesses that in consideration of the said two Sums of £100 and £200 paid to the said John Caryll and Thomas Peace and £200 to the said Jeremiah Bentham by Sir Matthew the said Advowson was conveyed to the said Sir Matthew Fetherstonhaugh
