Recites: deed of even date declaring the uses of a fine in respect of 2 to JC [AMS 1442]; settlement on the marriage of JW the elder and his wife Elizabeth, 14 Apr 1671 [AMS 1437]; separation agreement by which Elizabeth parted with her interest in a leasehold estate in Southwark to secure £30 a year out of 1, by which JW became bound to JB and Edward Hatfeild, now deceased, 1 May 1694; refusal of JW to perform the agreement; bill in chancery followed by new agreement securing Elizabeth an annuity of £20 out of 1 and that she should have it as her jointure should she survive JW; mortgage and further charge to WG as AMS 1440, 11 Nov 1690 and 19 May 1701; assignment of mortgage to Philip Cheale of Henfield and John Chatfield of Mockford [in Cowfold] in trust; surrender of 3 by JW and EW to EH and JB

 

WG and EH to hold 1 in trust to pay £20 a year to EW, the surplus (and the whole amount after her death) in trust to discharge the mortgage, the remainder in trust for JW the younger; JB granted power of entry to levy the annuity in case of non-payment; JW the elder covenants with JB that Elizabeth may live with anyone without molestation from him, and to have power to receive and dipose of the goods in her possession; EH and JB to hold 3 in trust for EW and her heirs; JW bound to EH and JB in £500 not to molest EW or any of her friends or acquaintances who receive or entertain her, to be enforced by JB by a suit in chancery
