Contents:
To sons of Holy Mother Church, the Abbot of Shrewsbury has granted by the assent of the Convent to John son of William de Bassechirche the land of Mere which his father held, that is with the pool and mill, in fee and heredity to him and his heirs, paying thence annually 4 shillings for all services at the feast of St. Michael.

Contents:
Richard Lord of the Mare and John his son and heir give and confirm forever to John son of John of the Mare one house next to the grantors' gate with half a croft called liht port (gate), which half lies between the grantors' gate next to the king's highway and the house which was sometime of William son of Mabel; they grant also 3 acres of land in the fields of the said vill of the Mare, of which 1 lies in the field of the mill immediately between the grantors' land and the highway, with 1 little meadow in the same field in the head of a certain acre called Peselont; the 2nd acre is in the field of the spring (fontis), between the acre of John de Prestecote and the acre of Sibil daughter of Morvid; and the 3rd acre is in the field against Bassechirche between an acre of John, father of the said John and an acre of Hugh son of Hugh. To hold of the grantors and their heirs to John, his heirs or assigns in fee and heredity, freely and quietly, with easements &c. The grantors also give liberty to make a ditch round the half croft and to plant the ditch with thorns (spinis) and enjoy it without contradiction from the grantors. They will and grant to John fishing in all their waters freely and quietly and also in their mill pond, but not to put in the said pond any engines which are called Chorf and wile lest their water-course to the mill be impeded; and they to John and his heirs all their waters will defend from all fishes not inhabiting the vill of the mare; and if any strange fisher comes to fish in the said waters, it shall be lawful for John and his heirs to take from him his fishing tackle (ingenia). If John or his heirs offend against the grantors or their heirs, such offence is to be rectified according to the discretion of 2 honest men on his part and two on the grantors; and if John of his heirs die upon the land, they will give to the grantors and their heirs 6d, saving all their goods and chattels, moveable and immoveable to him and his heirs, and his succeeding heir of the inheritance after the death of every heir shall give to the grantors and their heirs 12d for a relief and the grantors and their heirs shall receive of him homage and service without contradiction. And for this gift and grant and confirmation of the deed John gave them 15/- of silver beforehand, he and his heirs paying annually to the grantors and their heirs 12d at the feast of St. Michael for all secular services, exactions and demands, and for suit of court saving the foreign service to such land belonging.

Rent: a rose on the Nativity of St. John Baptist for all services, etc.

John Strange 5th Lord of Knokyn and knight gave to John de la Mere and his heirs one messuage with a curtilage and ½ virgate of land in the vill of Marton and outside it, that is what John son of Robert once held of John in the same vill. To hold of John and his heirs to John de la Mere and his heirs or assigns freely, quietly, in peace, in wood and in plain, meadow, pastures, in ways, lanes and in moors and in all other places, with all easements belonging, in fee and heredity, forever. Paying yearly to John S. and his heirs one half penny at Michaelmas for all secular services and suits. He grants to the said John de la Mare, his heirs and assigns to have in Muddelwode and in the Barndwode and in all moors reasonable fencing (or brushwood) to fill in (clausadum) his hedges and repair his houses, except oak, without condition or impediment by the grantor or his heirs. He wishes John and his heirs to have common of pasture for all beasts as freely as other free tenants are accustomed to use it, forever. Warranty against all men and women.

John lord of Mere grants to Roger son of Adam son of Hugh of Lopynton in free marriage with Sibilla, John's daughter, all John's land and tenement and all his claim which he has or could have in the vill of Mere. To hold of the chief lords of the fee to Roger, Sibill and his heirs procreated by them; if none, and Roger outlives Sibill, then to Roger, his heirs and assigns forever. Rendering to the lord Abbot and Convent of Salop while they live due and accustomed services.

Sibilla was the true heir of the said lands and tenements and that the said Margaret her mother was not a bastard.

Nicholas Hare, knt. and John Hare of London, mercer, release and demise to Richard Chambre, gent, all the tithes of a certain field in Mere in the parish of Baschurch which the Hares lately had, amongst other things, for a certain sum of money of the gift of their most invincible prince the lord Henry VIII &c according to letters patent of the same King enrolled in the Court of Chancery, dated 9 July instant, and which tithes were formerly part of the possessions of the late Monastery of Salop, and came to the king by the surrender and dissolution of the late monastery. To hold to Richard and his heirs and assigns to their use forever, of the king by fealty and not in chief. Rent: 4d p.a. to the Court of Augmentations of Crown Revenues, at Michaelmas.

By an inquest before Adam Lutley Esq. late Eschaetor in Co. Salop on the death of Francis Warde, gent, stating F.W. was seised in his demesne as of fee in 1 messuage, 80a land, 10a meadow, 20a pasture, in Meyre near Baschurch and in 1 cottage, 10a land, 3a meadow, and 7a pasture in Stanworthin in field and of 1 water mill called Bentmill in or near Mylford, Baschurch; 1 other water mill called Mylford Mill in Mylford; and by writing under his seal 11 February 26 Elizabeth (1583/4) together with Katerine his wife granted and enfeoffed to Thomas Adams of Longdon esq. and William Lloyd of Myddleton, Montgom. gent, all the said messuages, lands and mills in the Meare, Stonarton, the Bent Myll and Mylford Myll in the parish of Baschurch (Thomas and William Trevor, George Cowper, George Chambers, gents, and Robert Bennett;) to hold to T.A. and W.L. and their heirs, forever, to the use of Roger Warde son of Francis Warde and the heirs of his body, and in defualt of such issue to the use of Francis Ward, third son of the said Francis Ward and the heirs of his body; and in default to the use of Simon Ward, 2nd son of Francis and the heirs of his body; and in default to the use of Arthur Ward 4th son of Francis and the heirs of his body, and in default to the use of the right heirs of Francis forever; by virtue of which Addams and Lloyde were seised of the said premises as of fee to the said uses; and immediately afterwards by pretext of an Acto of Parliament of 27 Henry VIII for transferring uses into possession, Roger Ward was seised in his demesne as of fee tail, that is to him and the heirs of his body in the said property remainder to sons Francis, then Simon, then Arthur; and that Francis Ward the father was seised in demesne as of fee on the day he died in 1 messuage, 3 cottages, 40a land, 30a pasture, 10a meadow, in Newtowne and Baschurch, and being thus seised he died, and the property is held of the Queen by military service as 100th part of a knight's fee. F.W. died 16 November 26 Elizabeth, and Roger Ward is his nearest son and heir; Roger Ward at the time of the death of Francis Ward his father, was aged 24 years and more; and because Roger paid all the services, issues and profits of the property due to the crown up to 12 November 27 Elizabeth to the Court of Wards and Liveries, the Queen for 8d into the Hamper, adjourns his homage until the feast of All Saints next, returns to him the property and takes his fealty. The Queen orders the escheator to grant Roger full seisin of the property which at the time of the death of Francis his father was in the hands of the Queen, and remained there from the death of Francis until 12 November last.

In performance of convenants in an indenture of 10 October instant, between the same parties, being a bargain and sale of the premises below, inter alia, the Wardes release their right in the messuage, farm and tenement and in all lands &c called the Meyre alias the Mayre in the parish of Baschurch, and all other property in the Meyre of which Francis Warde, gent, decd., father of the said Roger and of the said Francis and Arthur was seised in his lifetime in a state of inheritance; and in 2 water corn mills called the Bent Mylls and in the water corn mill called Myllford Myll in the parish of Baschurch and in all pools, fishponds belonging to the mills. To hold to William Jones and Thomas Robyns and the heirs and assigns of William Jones forever under the condition declared in the said indenture. To hold of the chief lords of the fee by services due and accustomed. Warranty. Sealed and delivered.

Memorandum that Arthur Chambre of Petton, Esq., acknowledges to have requested and asked licence of Roger Warde snr. of Newton, Baschurch, gent., for the bringing and carrying of a boat over a place called the Meere ground to the Meere Poole as also for landing the said boat on the said Roger Warde's ground joining to the said Meere.

An attested copy of the above made 28 May 1731 with the note that Mr Chamber was then the owner of the tithe of the Meere ground the which tithe my father purchased long since and now is mine. I have a small ould deed concerning fishing there but it is written in lattin in ould courte hand the which I cannot read. I do believe that this place called the Mearhous and Mearsground had its name from thence which estate hath been in mortgage near sixty year unto one or other and a great deal of the time unto a gentleman that lived at London and now at last redemmed by me for the right heir so that our right have been long neglected.

Whereas by indenture of 4 October 33 Charles II between the said Arthur Ward described there as snr. of Hinton,gent (1), the said Thomas Freeman then of Newtown Baschurch, yeoman (2) A.W. in consideration of £100 demised to T.F. for 1000 years his messuage in Newtown Baschurch (Wm Evans) and all those his mills called Milward Mills in the Township of Adcot and Lordship of Great Shrawardine - redeemable on payment of £100 and interest at a date long since past.
Whereas Arthur Ward by a writing of 2 January 1683/4 for a further sum of £50 from T.F. agreed to charge the premises with £50.
Whereas the freehold and equity of redmption belongs to the said Elizabeth, and the said T.F. and Robert and Elizabeth have accounted together re what principal money and interest is due to T.F. - £150 principal unpaid, and £13 interest. Now T.F. for £165 from Thomas Harris, with the consent of Offley, assigns the mortgaged premises to T.H. for the rest of 1000 years.

There is a suit depending between Thomas Hunt and Richard W.Offley and others, which suit is supported by his grandfather Richard Payne re their right to keep a boat and to fish on the Burghe Poole or Mere which adjoins their ground at the Merebank in the parish of Baschurch, which pool or mere is claimed by Thomas Hunt as his sole right belonging to his capital mansion called Boreatton House for the Manor of Baschurch.
To prevent further proceedings at law during the life of Thomas Hunt, and to preserve friendly understanding and correspondnece between Thomas Hunt and Richard Payne and Richard Ward Offley, Thomas H. agrees to permit Richard P. and R.W.O. to keep a boat on the said Burghe Poole during the life of Thomas Ho, on the following conditions:-
P. & W.O. are not to let out to hire the said boat put onto the pool by them, or lend out thesaid boat to strangers, nor to take up any nets or W ?leatches laid in the pool by T.H. or his agents for catching fish, nor to take out any fish out of any trunk laid in the said pool by T.H. for keeping fish, and they shall keept their boat locked when not fishing on the pool. P. & W.O. covenant re this, and will keep the boat locked unless any idle person breaks the lock or chains of the boat. Thomas H. wont disturb the nets or trunks kept on the pool by P. & W.O. P. & W.O. are not to interrupt Thomas Hunt or his agent in passing their ground at the Merebank in going to fish or coming from fishing in the pool; and whenever T.H. has occasion to take a boat or trunk to or from the said Burghe Pool they shall not interrupt but permit T.H. and his agents to do so, they doing no wilful damage. Nothing to hinder anyone's right or title to the fishery of the said pool, nor give a new right to anyone.
Memorandum that if T.H. and his agents are not hindered in their ways to the pool neither P. nor W.O. shall be in anyway disturbed as to their boat or fishery on the pool.

Kenyon is the surviving trustee of the will and he levied the £4000 as directed; that by an indenture of 7 May 1839 between W.W.E. Wynne (1) Mary Slaney, spinster (2), R.H. Slaney and Elizabeth his wife (3) T.C. Eyton, W.H. Slaney, J.R. Ormsby Gore and R. Williames Vaughan (4) being the settlement before the marriage of M. Slaney and W.W.E. Wynne, it was declared that T.C. Eyton, W.H. Slaney and J.R. By an indenture of 12 September 1846 between Parry (1) Elizabeth Parry, spinster (2), John Billingsley Parry Esq. (3) and Wheble (4) in consideration of sums amounting to £12,282 paid by Wheble to Parry, J.P. granted to W. the manor of Yeaton and all property in Yeaton, Yagden and Baschurch in the schedule (340a 1r 38p). By an indenture of 27 August 1850 between Wheble (1) the Earl of Howth and Lady Catherine, St Lawrence, 2nd daughter (2) Eyston, Riddell, Viscount St. L. and Borough (3) in consideration of the marriage between Wheble and Lady Catherine, Wheble assigned the said sum to (2) to uses.
On 18 September 1848 the premises were mortgaged by J.P. to Scarlett Lloyd Parry for £2,500, and further mortgaged to S.L.P. on 1 July 1850 for £3450. On 3 November 1857 £2,282, and on 11 December £5,000 were paid by J.P. to Eyston &c in part of the £12,282, leaving £5000, and on 8 December 1857 the premises in the above indentures were conveyed to Robert Aglionby Slaney Esq freed from securities, that is 43a 2r 24p. 1 January 1859 an indenture between S.L. Parry (1) James Parry (2), J.B. Parry (3) Eyston &c (4) in consideration of £2500 paid by (4) to (1) and £500 to J. Parry, S.L.P. released to (4) the premises, except what was sold to R.A. Slaney. On 18 August 1859 £500, and on 18 October 1860 £500 were paid by J. Parry to Eyston &c in part discharge of £5,000 and £2,000 reducing it to £2,800. On 25 March 1863 the Manor of Yeaton and part of the said property (102a 2r 35p) was conveyed to Daniel Carr, Esq. freed from securities. By an indenture of 26 March 1863 between J.P. (1) Eyston &c (2) J.P. charged the rest of the property with £2,200 as well as with £2,800. On 25 September 1868 by an indenture between J.P. and Eyston &c a further charge of £1,000 was made. The principal sums of £2,800 and £2,200 and £1,000 (£6,000) remain due to Eyston &c. F. Sandford has agreed to pay £6,000, and the mortgage is therefore transferred to him.

By an indenture of 24 March 1886 the property was granted to Slaney and Corbet for 99 years or the life of A.P. Lloyd, to keep on foot the policies for the benefit of the inheritance of the premises comprised in the settlement of 1885.
By an indenture of 9 October 1886 in consideration of £5,000 from A.H.O. Lloyd to A.P. Lloyd, the premises were conveyed to Slaney and Corbet on trusts. On 13 July 1888 the property was assured to the use of Henry Graham Lloyd by way of mortgage to secure £5,000.
Indenture of 24 June 1830 between Sir Henry Wakeman, bart. and Dame Sarah his wife (1) Sir Offley Penbury Wakeman, bart (then Esq.)(2) James Wakeman (3) Thomas White (4) and Edward Cludd and the Rev. Edward Ryce Owen (5) certain hereditaments were limited to uses prior to the life estate limited to Sir Offiley with remainder to Sir O. for life, remainder to the first son of Sir O. & his heirs male. Sir Offley made his will 19 December 1848 leaving all freehold lands in Salop and Worcestershire to trustees with a rent charge for his wife, who died in his lifetime, directing his Salop lands to uses in the settlement of 1830 above. He died on 21 September 1858; Sir Offley, party, is eldest son of Sir O.P.W. and was born in 1850. Certain hereditaments in the County of Salop were sold and £20,77 18s 2d 2¾% Consolidated Bank Annuities in Court represented money from the sale. By an order of 2 August 1888 Adlington, Salwey and William St. Andrew Rouse Boughton were appointed trustees and Consols were transferred to them. Thomas Longueville Longueville died on 27 October 1888 leaving a will of 26 January 1886 appointing his daughter Anna Maria, his son Thomas Longueville, and nephew Roberts his executors; probate was granted on 24 November 1888.

William Brayne late of Mardol Head, Shrewsbury, was seised in fee simple at his death of a dwellinghouse and garden, farmhouse and buildings adjoining together with the farm then occupied by Richard Pugh, with a piece of land then occupied by the Rev. William Hopkins (160 acres)&devised the same to John Bather Esq. of Dulthill, Salop, and his heirs, subject to his paying his brother Arthur Henry Baher during his life £50 p.a. William Brayne died on 30 December 1844, and his will was proved 28 February 1851. John Bather made his will on 29 July 1865 devising all the property in Meole Brace, St. Mary, Shrewsbury, and Fitz, except the advowson, to his brother A.H., and Julius Beilby of Edinburgh, Esq., on trusts, for the eldest son Edward William Bather for life, trustees receive the rents until E.W. 25. He gave his wife Isabella an annuity out of the rents, and to each of the children, except E.W. £2000, charging the estate with the same. Power of sale and exchange given to the trustees, while receiving the rents. John Bather made a codicil on 15 January 1877 declaring E.W. was entitled to the rents whether he attained 25 or not. J.B. died on 21 May 1886, and his will was proved 30 July 1886. Isabella died on 16 June 1886. By an indenture of 20 April 1888 between Edward William Bather (1), Arthur Henry Bather (2) William Henry Bather (3), appointing W.H.B. trustee in place of Beilby who refused to act. By indenture of 24 June 1830 between Sir Henry Wakeman and Dame Sarah his wife (1), Sir Offley Penbury Wakeman (2), James Wakeman (3) Thomas White (4) Edward Cludd and the Rev. Edward Ryce Owen (5) certain hereditaments were limited to Sir O.P.W. for life, remainder to his heirs male. Sir O.P.W. made his will on 19 December 1848 devising all his lands in Salop and Worcestershire to trustees, with a rent charge for his wife, but she died in his lifetime, and the Salop lands to the uses of the settlement of 1830. He died on 21 September 1858. Sir Offley Wakeman, party, is his eldest son, and was born in 1850. By an Order in 1875 certain hereditaments subject to the uses in the will of Sir O.P.W. were sold for Consols. By an Order of 4 August 1888 Henry Smith Adlington, Alfred Salwey and William St. Andrew Rouse Boughton were appointed trustees of the settlement made by the will of Sir O.P. Wakeman. Edward William Bather as tenant for life in possession under the will of John Bather has agreed with Sir Offley Wakeman for the sale for £5,300 of the property below, to be paid out of the Consols.
Now sale to the trustees of Sir Offley Wakeman of the messuages, farms and lands in Fitz (126a 2r 9p). To hold freed from the annuity of £50 charged by the will of Brayne.

Evan Bowen by his will of 19 September 1876 left the mortgage to his brother John Bowen and to Thomas Lloyd Bowen, joint executors, but by a codicil of 10 October 1876 revoked the appointment of T. L. Bowen as trustee and executor and appointed William Payne in his place. Evan Bowen died on 15 December 1876. By a deed of 22 March 1877 William Payne renounced his powers as trustee. His will was proved 18 April 1877 by John Bowen, executor. By an Order of the Vice Chancellor of 2 December 1878 in an action in which J. Bowen was plaintiff, John Bowen Jones and Elizabeth Margaret his wife, and Ann Charlotte Bowen were defendants, J.B. was to appoint Samuel Urwick Jones new trustee. On 4 January 1879 J.B. appointed Samuel U. Jones as a trustee.
£600 and the interest from the mortgage were paid 27 September 1879, but no reconveyance was made. John Jones died on 1 February 1886, having by his will of 22 May 1885 appinted his friends Richard George Hooper Tomson and John Bates trustees and executors of his will to whom he left all his real estate. His will was proved 6 March 1886. Samuel Urwick Jones died in December 1882 leaving John Bowen as trustee. By an Order of a Judge before whom action was pending, 11 April 1883, J.B. was to appoint William Harding a trustee, which was done 23 May 1883, but Harding died on 5 February 1885. By the Order of 10 August 1885 J. Bowen was appoint John William Margetts as trustee &c, which was done 31 October 1885.

An undivided ninth of the parcel of land is vested in Leake and Adlington as trustees, but they have no power to seal the same except under the provisions in the Railway Act and the Lands Clauses Consolidations Act.
The Company nominate Timotheus Burd of Shrewsbury an able practical surveyor and the trustees nominate Samuel Harding Achdown of Uppington another able surveyor who by their valuation to determine the purchase money to be paid by the Company for the purchase, and compensation for damage done by the Company.

5. Every tenant dying seized of land at his decease shall pay 'oone his best quick good herrolds' and for lack of quick good onne his best moratle good.
6. Every tenant is at liberty to let his holding down, and leave his lands in the lord's hands and he will, and then the lord is to have the profit of that land till the heir come again and every tenant so leaving his land shall come in and have his entry without let of the lord or his heirs at any time that he is disposed to come.

By lease and release of 17 and 18 August 1827 the mortgage on the property was assigned to Henry Wakeman.
The property consisted of a tenement & in Upper Hayton (formerly John Gravenor, then Benjamin Hill, late of Thomas Whitton, then John Hickman); a tenement in Upper Hayton (formerly Rowland Watkins, then Richard Ward, then Benjamin Hill, then J.G. Hill, then John Hickman) - all which amount to 133 acres.
By lease and release of 29 and 30 June 1830 Sir Henry Wakeman vested all the large sums secured to him by mortgages &c in Offley Penbury Wakeman and the Rev. Edward Ward Wakeman, on trusts.

Sir Henry and Lady Wakeman have contracted to sell to Mr Wall a freehold estate called Meare Bank in Baschurch for £12,500, part of the premises in the settlement.
Thomas and Penbury the trustees are both dead; Thomas died in 1803 and Penbury in 1824, intestate, leaving his only sister Martha Lloyd who died in 1826 intestate, leaving Sarah Wakeman, now Lady Wakeman, her niece and heir-at-law. Therefore as heir at law of the heir of the surviving trustee can Lady Wakeman give the purchaser a marketable title? The Meare Bank Estate is not sold to increase the income of the tenant for life, but to purchase another freehold estate, Rorrington Hall, Chirbury, of greater value, to be vested in the trustees to be limited to the uses of the settlement, in exchange for Meare Bank. The purchase money for Rorrington is £15,200 and Meare Bank is to be sold for £12,500. A fine was levied last Trinity Term by the Wakemans.

Note that William Thomas died 24 March 1803, and Edward Penbury died 7 March 1824, intestate, leaving his only sister Martha Lloyd who died intestate in 1826 leaving her niece Sarah Wakeman her heir-at-law. A deed is to be prepared appointing William Cludde of Orleton and the Rev. Edward Pryse Owen, Vicar of Wellington, as trustees in place of Penbury and Thomas.
N.B. No power in the settlement for appointing new trustees and Lady Wakeman is the heir at law of the heir of the surviving trustee.

As Sir Henry Wakeman has been created a Baronet, he and Lady Wakeman, with their eldest son Offley Penbury Wakeman, have agreed to revoke the limitations in the former settlement and by suffering a recovery to resettle the same to the uses and trusts below. The Mearehouse has been sold but all other premises, freehold and copyhold in the settlement are to be resettled. Lady W. stands seised in fee as heir at law of her aunt Martha Lloyd to several freehold houses, farms, land and copyhold called Wotherton, Hinton and Woodmore in Chirbury and Pontesbury which are also to be settled. Sir Henry W. is also entitled by purchase to the Manor of Ford and to certain freehold farms, lands &c at Hinton, Pontesbury and Ford and to a copyhold estate called the Lea in Pontesbury which is to be settled. The Manor of Rorrington is also to be settled. Mr Salmon is to peruse the papers herewith sent and to prepare a deed to make a tenant to the precipe for suffering a recovery of the premises in the settlement from Sir H. and Lady W. and O.P.W. Esq to Mr Thomas White of Lincolns Inn, gent., with James Wakeman demandant, Thomas White tenant and Sir H. & Lady W. & O.P.W. vouchees.
The estates in the settlement and those Lady W. acquires from Mrs Lloyd the above freehold and copyhold premises belong to Sir Henry and the Rorrington estate to be settled and limited by the same or a separate deed to Edward Cludde of Orleton House, Wrockwardine, esq. and the Rev. Edward Pryce Owen, Vicar of Wellington, clerk to following uses:-
To Sir Henry for life - aforesaid; for Lady Wakeman for life - aforesaid, to Offley Penbury W., eldest son, for life and then to his issue male on failure of which to the Rev. Edward Ward Wakeman, 2nd and only other son, for life, and his issue male, on failure of which to Offley's female issue, on failure of which to Edward's female issue, on failure of which to Miss Emily Offley Wakeman, the only daughter, in fee, and in case of her death unmarried undertake such parts of the above estate belonging to Sir Henry to vest in and belong to Mrs Snepp (the only surviving child of Sir Henry by his marriage) wife of Thomas Snepp esq. and her issue, to be held by her trustees on the uses and trusts in her marriage settlement. As to such parts of the estate belonging solely to Lady W. to descend to her own right heirs. The trustees to preserve contingent remainders AB & CD, the trustees of the term for raising portions Bentley and Lechmere. Power enabling Mr Offley W. to settle the Rorrington estate on any lady he marries during her widowhood whether she marries again or not by way of jointure; full powers of sale & exchange and leasing; powers authorising the trustees to raise £8000 on the Wotherton premises but no larger sum to be charged at any one time for the portion of Mr Wakeman's younger children if mor than one but if one then £4000 only, the same power to extend to succeeding tenants for life if not raised by Mr W.
The recovery will be passed as of next Trinity Term, Sir Henry's title being limited to the issue male of his 2 sons, his landed estates should descend with the title and Mr Edward's issue male should be preferred to Mr Wakeman's female issue.
As to the deed assigning Sir Henry's personal estate - Sir Henry wishes this deed should include his leasehold property so as to have reference to his will to save the probate duty which cannot be done, and that the household furniture should be included if advisable.
Mrs Snepp will have to sell under this deed £15100 - £4000 part thereof her portion under the first settlement, £4000 part thereof under the will of Mr Harris, and which £15100 with £2000 relinquished by Sir Henry on her marriage and £2900 paid her on the 29 August 1815 make her total portion £20,000. The draft is to altered accordingly.
As to Sir Henry's Will - a copy sent prepared in February last, to be altered so far as the deed of resettlement and the assignment of the personal estate make it necessary. There is no power in the will making Mr Wakeman and Mr Edward W. to raise portions for younger children; it only extends to Ann Snepp or James Wakeman, so insert one authorising Offley to raise £8000 for younger children but if only one then £4000 the same to extend to all the succeeding tenants for life if not raised by Offley. As to the household furniture and leasehold to determine whether they can with safety be taken out of the will and included in the deed assigning the personal estate, but it is submitted they had better not, the legacies to remain in the will. A power to be given of exchange besides the power of sale.

Reciting that Sir Henry Wakeman had issue by Dame Sarah his wife, Offley P. Wakeman, eldest son, the Rev. Edward Ward Wakeman, Clerk, only other son and Emily Wakeman spinster only daughter, who had all attained 21. Reciting Sir Henry and Sarah his wife in her right were sesised in fee simple of the freehold houses, farms and lands in the townships of Hinton, Lea and Wotherton in the parishes of Pontesbury and Chirbury, secondly described below and secondly released, which property on the death of Martha Lloyd late of Montgomery, intestate in about 1826 descended to Dame Sarah Wakeman as her niece and heir at law.
Reciting a feoffment of 1 July 1828 between John Jones of Maesmaur, Mont. Esq and Mary his wife (1) Sir Henry Wakeman and Dame Sarah (therein called Dame Sarah Sobieski) his wife (2) Offley Penbury Wakeman (3) Edward Cludde and Edward Pryce Owen (4) Thomas Jones of Penbryn, Mont. gent (5) in consideration of £15,200 to John Jones from Sir Henry, J.J. granted to Edward Cludde and Edward Pryce Owen the Manor of Rorrington in the parish of Chirbury and the houses and lands in Rorrington, Wilmington and Wotherton in Chirbury parish, thirdly therein particularly described, to the use of Sir Henry for life, then to Dame Sarah for life, and to such uses as Sir Henry appointed, or to O.P. Wakeman for life.
Sir Henry and Dame Sarah and Offley P. Wakeman agreed to settle inter alia the property in Hinton, Lea & Wotherton inherited from Martha Lloyd, and the Manor and property in the feoffment of 1 July 1828.
To enable them to make the settlement of other estates firstly described it was necessary that they should suffer a common recovery, including in it the inherited Pontesbury and Chirbury property to save the expense of a fine. They therefore secondly granted to Thomas White the freehold houses, farms and lands called Wotherton, Hinton and Woodmore in Hinton, Lea & Wotherton in the parishes of Pontesbury and Chirbury, inherited from Martha Lloyd, to make him tenant to the precipe to suffer a recovery in the Trinity Term, with James Wakeman demandant.

Proviso that O.P.W. could make a settlement on a wife for her or their lives of all or part of the manor &c thirdly released.
Proviso that O.P.W. may and find E.W.W. and E.O.W. also may when entitled to the property, subject to any trusts &c charge the property secondly released with the payment of any sums for the portions of children except the eldest son or daughter entitled to the property immediately expectant on the death of his or her parent or of Sir Henry or Dame Sarah not exceeding £4000 for any one child, nor £8000 for any 2 or more children with interest at not more than £4% p.a.
Power to tenants for life in possession and trustees during minority to grant leases for 21 years.
Powers of sale and exchange to trustees with consent of tenants for life, the lands bought or taken in exchange to be settled to the same uses.

Edward Ward Wakeman died September 1855 having had one son, Offley Francis Drake Wakeman, over 21. Adlington was appointed trustee in place of Edward Pryce Owen, deceased.

Mr Penbury asks for the names of the persons concerned with damaging the timber, and rebukes the present tenant for his behaviour. He asks Lloyd to let the tenant and his father-in-law Hopkins (who is a reponsible tenant of Edward Penbury's) know that Edward Penbury will make them pay for any damage of the building etc. He wishes Lloyd to get a man to mark and number the trees.
Note. Edward Penbury also wrote to Mr William Hopkins at Trefnant near Pool on the same subject.

By indenture of 13 August 1737 between Richard Chambre of Burlton, Clerk (1), Mary Fosbrooke of Shrewsbury, widow and executrix of John Fosbrooke of Shrewsbury, gent, deceased (2) William Calcot (3) Samuel and James Locke (4), reciting that Francis Chambre of Petton, Gent, on 8 April 1730 lent to William Calcot £200, for bond of William Calcott of 8 April 1730, but by indenture of that day he mortgaged the capital messuage in Chirbury called Kinton Farm (then or late Andrew Phillips) for 500 years. By indenture of 22 March 1730/1 between Francis Chambre (1) Richard Chambre (2) William Calcot (3) - reciting that £9 10s interest was due, the mortgage was assigned to Richard Chambre for £209 10s from Richard to Francis Chamber and £190 10s from Richard to William Calcot. Then due to Richard Chambre £427 17s 5d. The Lockes lent William Chambre £1,000 on security of the said property, and on security of the term of 500 years in other premises mentioned below granted to John Fosbrooke deceased by William Calcot by mortgage to secure £500. By indenture of 13 August 1730 for £427 17s 5d to Richard Chambre paid by the Lockes, Richard Chambre assigned to the Lockes the said property for the rest of 500 years.
By mortgage of 15 June 1733 between William Calcott (1) John Fosbrooke (2) for £500, mortgage of the said capital messuage and farm called Kinton Farm, 2 messuages in Middleton (widow Olivers and Joseph Brown), and 2 messuages in Middleton (William Brown) for 500 years.
John Fosbrooke died on 12 July 1733 - will of which Mary Fosbrooke executrix - due to her £500 and £23 4s 6d interest. So by indenture of 13 August 1737 for £23 4s 6d to Mary Fosbrooke from the Lockes and £48 18s 1d to William Calcott from the Lockes, which with the said £427 17s 5d paid to Chambre amounted to £1000, assignment to the Lockes of the said property for the rest of 500 years.
By indenture of 13 April 1752 between James Locke (1) John Harvey, one of the sons of Benjamin Harvey, ironmaster, by Sarah his late wife, deceased, daughter of Joshua Gee deceased (2) Henry Blakeway of Shrewsbury, gent (3) reciting by indenture of 14 August 1737 between the Lockes (1) Benjamin Harvey and Sarah his wife (2) reciting Joshua Gee by his will of 30 June 1730 gave to the Lockes £2000 to be put out at interest, in trust after the death of Sarah, daughter, to pay the same to her child or children, and in default of her direction, equally to her children at 21. He appointed his sons Samuel Gee and Osgood Gee executors. Joshua died 3 November 1730. His will was proved P.C.C. and the money paid to the Lockes. The Harveys applied to the Lockes to lay out £1000, part of the £2000, on the estate of William Calcot. It was declared by the indenture of 14 August 1737 that the Lockes were possessed of the several terms of 500 years and 500 years assigned by then indenture of 13 August 1737 to them, in trust for persons entitled under the will of Joshua Gee, Samuel Locke died, so the terms of years were vested solely in James Locke. Sarah, wife of Benjamin Harvey, died leaving 3 children - Benjamin, John and Mary. She made no appointment, so the money was to be equally divided when they were 21. John Harvey has attained 21 and so is entitled to £333 6s 8d, a third of the sum secured on the mortgage, and needing the same has applied to Henry Blakeway who agreed to pay his the same from 14 February last. So by indenture of 13 April 1752, for £335 13s 10d to John Harvey from Henry Blakeway, being the full share of principal and interest from 14 February last to 13 April, and for securing repayment of £333 6s 8d and interest to Blakeway, John Harvey agreed that James Locke should stand possessed of the said property in trust to secure the repayment of the said sum to Blakeway.
The sum of £333 6s 8d and interest has sometime since been paid by Rowland Calcot to Henry Blakeway, and John Harvey and Benjamin Harvey jnr. have been paid their parts of the £2000, the £666 13s 4d remaining due on the said mortgage belonged to Mary Northall who lived to attain 21, or to Thomas Northall in her right as her share of £2000. James Locke made his will, appointing Thomas Rollinson and James Harding executors. They proved it, so property was vested in them for the rest of the terms in trust for securing payment of £666 13s 4d. Mary Northall died without issue, so Thomas Northall is entitled to the said sum. By H.M. Commission of 11 April 17.. awarded against Thomas Northall, directed to Francis, John and Edward Ingram and Francis Rocke, Esq. and Thomas Milward, gent, the Ingrams found Northall exercised the trade of a grocer and sought to get his living by buying and selling and during that time was indebted to Richard Wall of Bewdley, grocer (who was the petitioning creditor for the suing out of the commission) in £100 and over, and Northall became a bankrupt and was declared so by the Commissioners.
By indenture of 16 April 1759 between the Ingrams (1) Richard Wall (2) the personal estate of the bankrupt was assigned to Wall in trust for self and other creditors of Northall.
By indenture of 1 September 1759 between Richard Wall (1) Francis Rocke, John and Francis Ingram (2) Francis Brown and Richard Pinches and Joseph Robston late of Bristol, grocer, since deceased (3) Wall had sold part of the effects of Thomas Northall, and the rest was assigned by the other creditors to (2) - assigned by Wall together with money from the sale and other money of Northall. There is now due to Rollinson and Harding as executors of James Locke £666 13 4d and £74 13 4d interest, in all £766 7s 5d which Rowland Calcot at the request of the surviving assingees of the effects of Thomas Northall has agreed to pay to Rollinson and Harding on their assigning all their estate in the said capital and other houses above for the rest of the terms of 500 years and 500 years to John Wood on trust. So for £766 7s 5d to Rollinson and Harding as executors of James Locke paid by Rowland Calcot, they assign to Wood the said property for the rest of the 2 terms, in trust for Rowland Calcot to attend the freehold and inheritance of the property

Recital of articles of agreement of 24 August 1752 between Rowland Calcott (1) Scarlett Lloyd and John Wood (2) Sarah wife of Rowland Calcott, decd. then Sarah Lloyd of Shrewsbury, spinster (3). A marriage was intended between Rowland Calcott and Sarah Lloyd. Rowland promised to convey to (2) the Manor of Middleton, the capital messuage in Chirbury called Kinton Farm (Andrew Phillips) and houses in Middleton and Stapeley (Andrew Phillips, widow Olivers, John Williams John Perkin and Edward Evans), to the use of Rowland Calcott for his life, remainde to Sarah for her life for her jointure, then to the first son of Rowland and Sarah in tail with ultimate reversion to the rights heirs of Rowland. Rowland was give the power by deed or will to charge the said property with a sum not over £1000 for the portions of the younger children. No settlement was made by Rowland, but by his will of 22 October 1762 he charged the property with £600 to be equally divided among his younger children, to be paid within 12 months of the death of his wife, with interest from the death of his wife at 4% p.a. The issue of the marriage was William and Sarah wife of Joseph Sutton. Rowland died on 4 November 1762, and Sarah his widow died on 27 February last, so £600 became payable 12 months later. William Calcott suffered a common recovery of the said property to discharge the same from estate tail and he desires it to be released from the £600 for the portion of Sarah, so for £600 from William to Joseph and Sarah Sutton, they release him and the property from the portion.

From 25 March next for 1 year and so from year to year. Rent: £160 p.a., paid quarterly, and £30 per.acre for any meadow or pasture ploughed up, and £10 for every load of hay, straw, dung, manure or compost grown on the premises and carried off the same. Husbandry covenants.
Dorse: Memo agreement of 20 August 1838 between the Rev. James Calcott Hayes Stokes of Manueten Rectory, Herefs, clerk (1) Richard Smout (2) Since the agreement Sarah Sutton has died and Stokes is now entitled to the said hereditaments. So agreed Smout to pay to Stokes £200 p.a. for the said hereditaments, beginning 29 September next. Stokes to allow Smout a third of what Smout spends on the farm in the next 3 years and for any draining done by Smout Stokes will allow half the expenses, first ascertained and certified by Mr Deighton. Stokes will allow Smout to "cup up [...] wollars in road and for driving up the Dingle the sum of Five pounds", and confirms the agreement.

Will of J.C.H. Stokes of 12 January 1848 bequeathing to his wife Susannah Frances all his freehold estates for her life, then to his daughter Katharine Emma Stokes and son Samuel Calcott Stokes. Executor: his son Samuel, and executrix: his wife.
Codicil revoking the bequest of freehold estates to his daughter and son and his son was then dead, and he gave it to his daughter on trust to sell the same, and appointed his daughter Katharine Emma and his son Calcott Stokes jointly with his wife to be executor and executrixes of his will. He died on 1 October 1850, and his will was proved in the P.C.C. on 3 April 1851. By indenture of 10 February 1849 endorsed on the back of the mortgage of 11 November 1845 (1439/17) the mortgage was transferred to Norton subject to the former mortgages. The principal sums of £2,500, £500, £2000 and £900 still remain due.
The personal estate of J.C.H. Stokes was insufficient to discharge the simple contract debts due from him at his death and the sale of his real estate has not been effected. Susannah F. Stokes needs to raise £600 to pay the debts of her late husband, so this has been advanced by Norton with interest at 5 %. So a further charge on the estate for £600 and interest.

Stokes (2) Thomas Norton (3), whereby the principal of £900 secured by the indenture of 11 November 1845 was transferred to Norton. Will of J.C.H. Stokes of 12 January 1848, and codicil (1439/19). William Henry Perry died on 6 December 1854, intestate, leaving John Eyton Perry, an infant, his eldest son and heir, and on 3 March 1855
Letters of administration of the goods of W.H. Perry were granted to his widow Mary Perry. J.E. Perry died on 8 May 1856, an infant, leaving his only brother William Robert Perry his heir. By a Decree of Chancery of 12 July 1858 it was ordered that the estates in the mortgages be sold and the money paid into the Bank into "The Mortgaged Estates Account." So the estates on 16 June 1859 were put up for auction in London, and Charles John Elwell was the highest bidder for Lot 1, bieng the property below, for £5,950 and the timber at valuation (£89), in all £6,039. He paid a deposit of £595 into the said account. By order of the court on 4 August 1859 Elwell was ordered to pay the balance to the Mortgaged Estates account, which was done 27 September 1859, and on 31 October 1859 he paid for the timber. Now conveyance of the capital messuage and farm called Kinton Farm (now or late John Gittins) (206a 3r 39p) shown in a plan and described in a schedule.

Charles John Elwell late of Compton, Tettenahll, Staffs, and of Wolverhampton, gent, deceased, by his will of 6 April 1865 made his brother Paul Elwell and James Lakin executors, and left to his wife, Sophia, £1000 p.a. for life, then to be divided among his brothers W.E.Elwell and Paul Elwell, and his sister Clara Thorn, and another annuities. Sophia died in the lifetime of the testator. Charles John Elwell died on 14 October 1875 leaving William E.Elwell his eldest brother and heir at law. His will was proved on 10 November 1875.
It has been agreed by the parties of the 2nd, 3rd, 4th and 5th parts that a division be made of the estate of the testator, and that the house and farm below be part of the share of Clara Thorn. So they convey to her the capital messuage and farm and lands in Chirbury called Kinton Farm (formerly John Gittins, now Benjamin Gittins) (206a 3r 39p) described in the schedule.

Thomas Dunn, if he is still with the testator, is to have £50.
Residue: to be divided equally among the 2 brothers and sister, and if any of them is dead, to divide that share among his or her children.
Proved at Lichfield 10 November 1875.
The Testator died on 14 October 1875.
Resworn at under £60,000 in March 1877.

Recital indenture of 25 October 1878 between William Thorn and Clara Thorn (1) H.W., C.S. and W.R. Thorn (2) acknowledged by Clara 7 November 1878. Clara married William on 6 January 1842,but no settlement was made. Issue - 7 children, named therein. William and Clara, by right of Clara, were seised of the premises to be conveyed in fee simple, so they conveyed the same H.W.,C.S. and W.R. Thorn on trust at the request of William and Clara, to sell the same, and included a power to let the same for a term not over 21 years. They have agreed with Sir Offley Wakeman for the sale to him of the said premises subject to a lease, for a sum, including timber, of £7,000. The recited indenture relates to other property as well as these premises, so it is agreed that the indenture should remain in the possession of Henry William Thorn etc. So conveyance of the capital messuage and farm and lands in Chirbury called Kinton Farm (formerly Benjamin Gittins, now George Cooke) (206a 3r 39p). To hold to Sir Offley Wakeman forever, subject to the lease of 1 July 1879 to George Cooke (/25).
