Walter Nicholas of Aymestrey co Hereford innkeeper aged 66

He knows the plaintiff and has once seen the defendant. He knows Richard Vale to be no common drunkerd swearer or alehouse hunter nor did use to hunt baudie houses, but sayth that he is a deacon and doth officiat in the parish of Aymestry and hath 20 nobles or there abouts allowed him for his yearly wages in house and lands, and that he hath alsoe served as curat in the parish of lucton and hath allowed him five pound yearely by the lady Crafts for his service there and hath money out and that there is a 100¹ or there abouts in several mens hands for the use of his children" He was accused 10 or 11 years since on suspicion of stealing 2 cows which upon search were found in his house and was bound over to the Sessions and there presented and acquitted - neither his father nor he compounded for the cattle.

Evidence of Richard Morgan of Stepleton co Hereford husbandman aged 62 years

He saw the defendant yesterday and wever before; to his knowledge he never saw the plaintiff

He never knew or heard but that Humphrey Vale (mentioned inthe interrogatory) was an honest man of good life and conversation - he had been formerly curate of Aymstry, whether continued there, this deponent knoweth not

He knows Richard Vale and knows that he was at Hereford assizes 10 or 11 years since, questioned for stealing cattle; never heard that Richard compounded for it but that on trial he was acquitted

He knows the defendant but not the plaintiff

Being at the house of Walter Nicholas about a fortnight since, Nicholas reported that the defendant and plaintiff were married about 21 years past, but neither he nor his wife were present; Humphry Vale reported the marriage as 25 years since

Evidence of Charles Kyffin of Kay Coch co Mont. gentleman aged 64

He knows both parties, they are cousins germans

He does not know that at any time they cohabited together as man and wife. About 13 or 14 years since, Mrs Mary Price the defendant's sister, at Montgomery and other places told the deponent that she had often questiones Mrs Phillipes the plt whether she were married to her brother the defendant, to which the plt affirmed that she was not.

About 13 years since, this Mrs Price told the deponent that there was a double match intended between the plaintiff and some gentleman in Radnorshire, and some of their sons and daughters

Thomas Powell told this deponent that the plaintiff and defendant had been married, at some place or other in Denbighshire. This Thomas Powell is hard of hearing and given to drink and distemper and very weak in his carriage and conditions and sometimes much inclining to dotage, he kept a typling house at Llanvillin and was married to a woman of an evil fame - he is run into debt and thereupon left his house and family. In the same discourse betwixt this deponent and Thomas Powell, the latter said that if he should not have maintenance from the defendent, he should have welcome and keeping with either Mrs Phillipes the plaintiff or at Penybont as long as he lived.

Divers in Llanvillin reported that the said Powell had been distracted and often saw strange visions and apparitions and that he was often watched in the night time with candles, how true it is this deponent knoweth not, this report was presently after he had been in a Commission in Radnorshire a witness for the plaintiff

Evidence of Charles Salisbury of Bychymbyd co Denbigh esq, aged 32

He says that within this half year, Mrs Hanmer came and called at this deponent's house and then having some frivolous discourse between them in relation to the plaintiff and defendant, it happened that at parting she, the said Mrs Hanmer, did speak unto this deponent that she was of aid this business should end in blood or words to that effect.

Evidence of David Thomas of Comb-nant helan co Mont. husbandman aged 35

He knows defendant, not plaintiff

He knows Thomas Powell, that he is on old man, hard of hearing and not very wise nor very foolish, and that he kept a typling house in Llanvillin and run into debt and left his house and family, and that the said Powell told him that his wife did spend in less than 5 weeks space the sum of £17 or thereabouts, and he went himself from house to house in Llanvillin and other places to spend his money and very often either drinking in some company or other or at tables;and it was reported that his wife was of an evil fame. This deponent heard Powell himself report that he had a light head, and that about a year since when he was in his health, he said "he saw apparitions in the Adre in the shape of women & maids", he himself also reported that he is uncle to the plaintiff and used to call her mistris

About a fortnight since, this deponent being at the house of Walter Nicholas in Aymestry in Herefordshire, he asked him (Walter) whether the plaintiff and defendent were married, to which he answered he did not see them married but heard a rumour of such a marriage - which was spoken by the maid Walter in English and after delivered in Welsh by a maid servant in the house to this deponent, he believed she interproted aright

The day after he had spoken with Walter, he did meet with Humphrey and asked him if the plaintiff and defendent were married, who answered that Mrs Phillipes was married to one Mr Vaughan 25 years since, but that he did not know Mr Vaughan, at which time the said Vale sate at his door without, having a needle and thrid and a leather thimble in his hand, and as he believes was about to mend his breeches

Evidence of Abigall Hanmer of Llanvyllin co Mont. spinster aged 30

She knows the defendent but not the plaintiff

About "Wensday was a seavenight" she come to an inn which had been formerly the Red Lyon in Aymstry in Herefordshire The man of that house, as she was told, was in this town this day and presently after her coming to that house, she asked the people of that house whether that was the house where Mrs Phillipes the plaintiff and Mr Vaughan the defendant were married, who answered, that they were not married there, and that they would not take £1000 to say that they were married at all; both man and wife of that house did say that they did not know Mr Vaughan

She knows Thomas Powell to be hard of hearing, that he was married to a woman of an Evil fame, that he kept a typling house in Llanvyllin, run into debt, and left his house and family, that Mr John Hanmer gave the said Powell's wife 5s and promised to send her a load of malt, but did send but 4 measures, as the said Powell's wife and her servant maid told this deponand (upon what condition, this deponent knoweth not). Powell, a little after he came from Presteigne about 4 of the Clock in the morning, met the depenent in the streets at Llanvyllin and amongst other discources, he then reported he could not sleep not have any rest day or night by reason he was much troubled and haunted with divers apparitions of evil spirits both night and day in the shape of gentlewomen young and old, which, as he said, turned to toads, froggs, monkies, jackynapses and other vermine and from that shape to the shape of faire gentlewomen young and old againe"

Evidence of Edward Mason of Churchstocke co Salop labourer, aged 40 years

He knows both plaintiff and defendent and has heard they are first cousins. He does not know that they lived together as man and wife

He has heard that Mr James Phillips, upon some difference between him and the plaintiff his then wife, did put her away, upon what occasion this deponent knoweth not. He heard it reported that the plaintiff did live incontinently with Mr Edward Morris of Penybont.

The plaintiff by the name of Frances Phillips widow purchased lands and paid for them and in other things acted by the name of Frances Phillipes widow. She purchased lands near llanddewi and paid £300 or thereabouts, and gave the said lands to her daughter Mrs Hanmer - he does not know whether the land was bought of one Smyth or no. He heard it reported that Mr Phillipes did in his lifetime being his estate (have) £35 by the year or thereabouts

He heard it reported that the defendent was bound as surety for the plaintiff in a bond to some one or other, but does not know to whom - she did subscribe herself by the name of Phillips widow within the space of 21 years past

About 15 or 16 years past or thereabouts, he being a servant in the plaintiff's then, Mr Edward Morris of Pen y bont did use to come to the plaintiff to Llanddewi, and sometimes would stay a week there and sometimes a fortnight "and that they were something familiar together but saw noe dishonesty between them"

He heard it reported that the defendent was bound in a bond of £1000 to Mr Lloyd Peirce for the plaintiff, who subscribed her name thereunto Frances Philipes widow

When he was a servant in the house of llanddewi about 15 or 16 years since, there came one Mr Latchet of Leene a suitor to the plaintiff, and the deponent did hear the plaintiff and Mr Latchet confer about several matches to be made betwixt themselves and their sons and daughters, that is to say, Mr Latchet his son and daughter should be married to the plaintiff's daughter and son, and after that performed the plaintiff would marry Mr Latchet, which the said Mr Latchet would not consent unto unless he himself were first married unto the plaintiff, and that the plaintiff denied.

He knows Thomas Powell to be hard of hearing, that he did keep a typling house in Llanvyllin and of smal respect and a doteing old man, and was married to a woman of an evil fame - he heard it reported he did run into debt and left his house and family and by report he had received loads of malt from Mrs Phillipes, upon what accompt he knoweth not, "he knowes he was the plaintiffs servant, this deponent being servant with him in the same house and did heare her call him uncle"

This deponent "sayeth that Mrs Dorothy Hanmer in that Interrogatory mentioned was of good report for anything he knoweth, but that he heard by report that her Brother Andrew Phillipes should say that she had forsworne herselfe against him and procurred her mother to doe the like. About May last "Mrs Dorothy Hanmer Comeing homewards from Radnorshire through Kerry she lighted at the house of one Mrs Jones, a widdow there, where she said to the said Mrs Jones that she wondered that this deponent would come to be a witnesse againsr the plaintiff her mother being her old servant in former tymes, which words she the said Mrs Jones told this deponent afterwards. And further deposeth that he being a servant to the plaintiff at llanddewi when the said Mr Latchet was suitor to the said plaintiff, he saw Mr Latchets man about 12 of the Clocke in the night or there abouts Comeing out of the plaintiffs bed Chamber she being then in that Chamber"

Evidence of Charles Griffithes of Llsnvillin co Mont. blacke smyth aged 42

He knows the defendent but not the plaintiff

He heard some say that the plaintiff and defendant were married and others say they were not married, but did not hear they did live and cohabit together as man and wife

He did see Mr James Phillips and did hear that the said plaintiff upon some discontent between her and her husband did live assunder but was after reconciled to him again and live both together

He heard Thomas Powell report that the plaintiff and defendant were married - he known Thomas Powell to be an old man, hard of hearing and neither very wife nor very foolish, that he kept an ale house in Llanvyllin, that he did run into debt, us he told this deponent, to the sum of £50, that he has left his house and family and gone as some say to Pentrepant, that a little before Christmas last the wife of the said Powell came to this deponent and told him that her husband was now well in health, since he was in a Commission in Radnorshire against the defendent and that Powell did often see several fancies as monkies, Baboones and women and did see the said beast copulate with the said women, and this deponent at the earnest entreaty of Powell's wife came to lay with the said Powell at his own house and he did there that night tell this deponent that he saw the said fancies and apparitions and asked divers times that night whether he saw them, when this deponent fastened his hands upon his eyes, he then confessed that he did see the said beast copulate as aforesaid with the women and he heard the said Powell say that he did not complain in the day time but was to this deponents knowledge as sincible in the day time as at other times, as this deponent delieveth. This deponent heard that Powell was not any way so troubled with any such fancies and apparitions before his going to that Commission in Radnorshire againar Mr Vaughan the now defendant

Powell told this deponent that the evil spitits had made his shins black and blew, which this deponent did see to be so but thought he had struck his shins to the bed posts for fear of the said apparitions

Bridgett Jones of Llanvillin co Mont spinster aged 21

She knows the defendent but not the plaintiff

She knows Thomas Powell to be hard of hearing - he told her he was light headed and did see strange apparitions in the shape of women in blew potticoats and that they would fain come to bedwito him

Evidence of Gabriell Price of Llanvyllin co Mont gentleman aged 64

He knows both parties and heard they were first cousins

In conference with Thomas Powell, Powell told him that he forgot where and when the plaintiff and defendant were married until he spoke with such as were with him at the marriage

Evidence of Mary Price of Llenvillin co Mont spinster aged 23

She knows both parties. She knows Thomas Powell to be hard of hearing - he told her in Christmas last that he saw divers apparitions in the shape of fine beautiful gentlewomen, monkies, toads, frogs and the like and that they would offer to bite him and come to bed to him, but a beautiful gentlewoman saw him "and further is not required"

Evidence of John Kyffin of Bodvach co Mont esq aged 34

He knows both parties, does not know that they ever lived together as man and wife

About the year 1647, he was often in the company of Thomas Powell and heard him severaltimes discourse of a marriage which he did then affirm did pass between Edward Vaughen no of Lloydiart esq and Mrs Frances Phillips, Powell calling her his mistress: this deponent did often demand from the said Powell when and where they were married, and he would always answer that it was about 12 or 14 (years) since and sometimes he told this deponent that Mr Vaughan and his mistress were married at Mr Thelwalls house at Plasse y warne in the County of Denbigh and that it was late in the night after most of that family were gone to bed, sometimes the said Powell did tell this deponent that both parties were married in Llanddewi at the house of Mrs Phillipes in the County of Radnor, sometimes that the marriage was effected in the County of Hereford and sometimes he mentioned other places - this deponent observice Powell to falter so often took the greater notice of his discourse

Evidence of Mary Powell of Llanvyllin co Mont. wife of Thomas Powell aged 48 years

She knows both parties. Powell is an old man, hard of hearing There was a horse load of malt sent to her husbands house from Pentrepant and afterwards Mrs Hanmer sent for money which this deponent did not pay, whether her husband paid she does not know. Thomas Powell since his coming from Presteigne from the Commission against Mr Vaughan the deft. was much troubled with strange apparitions in the night and one night above the rest he cryed out and said that some thing was ready to take him away through the roof of the house

He was well in the day time. Being saked how long he did continue in that condition, she said that it was too long for her sorrow

Howell Evans of Montgomer, gentleman aged 31

He knows both parties and believed them to be first cousins

He does not know that they were ever called man and wife or ever cohabited

He knew of a suit formerl depe nding between Mr James Phillips the plaintiffs husband and Mr Theoder Morris, upon what grounds this deponent knoweth not, but refers to records in the Ecclesiastical court where the some depended

He saw a copy of a bond in £1000 for payment of £500 dated 20 January 1640/1 and believed the plaintiff by the name of Frances Phillips widow sealed it - copy produced and endorsed by Commissioners. He took a copy of a fine passed by the plaintiff in the names of Frances Phillipes widow and Andrew Phillipes esq - also endorsed by the Commissioners About January last, this deponent having some conference with Mr Symen Thellwall, Mr Thelwall confessed that he himself with the defendant Edward Vaughan esq, had made many journeys to London and elsewhere to conpound the debts of the plaintiff's late husband Mr Phillipes - Mr Thelwall then said he knew nothing of a marriage

About 10 years past, this deponent with Mr Evan Lloyd went to retain Mr Powys to be of councell for the defendant in other causes in co Mont., who told them he had been of councell for Mrs Dorothy Meredith who was then plaintiff in the Court of Hereford, the issue being to prove the marriage between the now plaintiff and defendant, which they failed to do as Mr Powys then affirmed

He has seen 2 bonds dated 1638 sealed by the plaintiff by the name of Frances Phillipes widow to Charles Lloyd esq.

He knows Thomas Powell these 13 or 14 years to be deaf, that by report he was married to a women of an evil fame, that he kept a typling house in Llanvyllin, that he is much run into debt and left his house and family. He had conference at several times with Powell, who often told him that the plaintiff and defendant were married, sometimes it was done in Hereford, sometimes at Lemster, another time at --

He knows that Mrs Dorothy Hanmer often dolicited in London and elsewhere in this suit, and this deponent and Philip Weaver with others did repair to the house of Thomas Shipmens in Prestayne in Rednorshire 29 August 1656, at which time this deponent did desire to speak with Humphry Vale, Richard Vale, Walter Nicholas and his wife and one Thomas Powell, which this deponent with the rest were denied to speak with any of them, being all kept under locke and key by Mrs Dorothy Hanmer, as the saidshipmen told this deponent - he never heard the defendant say that all women were whores

He has never heard that they did at any time live and cohabit as man and wife. Upon some discourse between this deponent and Mr Theoder Morris, the latter told him that Edward Morris of Henvachey would say that James Phillipes did use to say in his cups that Dorothy Hanmer was not his daughter but the daughter of Edward Morris of Penybond. Theoder Morris told the deponent that there had been a suit between Phillipes and him, but what became of it or what damage or endiwas made, this deponent does not know

He saw a bond of £1000 dated 1640 in which the plaintiff by name of Frances Phillipes widow with others were bound to one Lloyd Peirce - he believes she was one of the parties Theoder Morris told him that Edward Morris told Theoder that Mr Evan Mederith told him that Morris Thomas the cook was taken between the legs of the plaintiff upon a pair of stairs in Glantannat

He knows Thomas Powell to be an old man, hard of hearing, of the age of 80, as he himself reported, that he married a woman of an evil fame, that he is run into great debt and kept a typling house in Llanvyllin and left his house and family and is gone to live with the plaintiff or some of her friends - he has heard by report of others that Powell saw visions in the night time since the Commission at Presteyne

Upon 13 August 1656, this deponent was at the house of Walter Nicholas at Aynestres co Hereford, where he was taken by the said Walter his wife for the defendant Mr Edward Vaughan, in the presence of Henry Llewis and Edward Powell

Evidence of Robert Lloyd of Castle Moch co Mont. gentleman aged 38

He knows both plaintiff and defendant and has known them these 20 years and upward and believes them to be first cousins. He knows not that they were married or did at any time live and cohabit as man and wife. The plaintiff by the name of Frances Phillips widow and Andrew Phillips esq her son and heir apparent, in the year 1646 or thereabouts sealed a lease to the defendant upon the capital house and some of the lands there called Kellynog in the township of Keven Coch in the parish of llanraydeer y mochnant co Mont. for the term of 21 years, as he remembers, which lease contained a provision that if the plaintiff and her son or some one of them should bons fides come to dwell there, then the lease was to be void - the lease was made by this deponent who saw it sealed and delivered by the complainent and her son to the use of the defendant; there was a rent of £10 reserved

He with Mr Evan Lloyd went to retain Mr Powis at Poole for the defendant in other causes and then Mr Powis told them that he was of councell for Mrs Dorothy Meredith then of late in Hereford session - he does not recollect the suit Mr Powis said they came short of their aim in proving the marriage between the now plaintiff and the defendant.

The deponent has been formerly in conference with Thomas Powell about the marriage who answered that they were married bur did differ in the names of the places of the said marriage

He was employed by the plaintiff to receive her rents of her tenants in Keven Coch in 1647 and 1648, and pay them over to herself and her daughter

He knows the defendant and bot the plaintiff

He knows Thomas Powell to be an old man, hard of hearing, that he kept an ale house or typling house in Llenvyllin and by report was married to a woman of an evil fame, that he run into debt and left his house and family, and that upon some conference bet this deponent and Powell being asked why he left his old master, he made answer he was never well since he had been at a Commission in Rednorshire against the defendant and afterwards was often troubled with evil spirits

Evidence of Edward Wynn of Llanvyllin co Mont gentleman aged 34

He knows both parties for many years, and has heard they were first cousins. He never heard that they lived together as man and wife. He heard that the plaintiff entered into bond and past a fine by the name of Frances Philips widow Thomas Powell is an old man, and deaf and he lived and kept an ale house or typling house in Llanvyllin, that he was married to a woman of an evil fame, and before the first Commission that was executed at Presteyne in Radnorshire betwixt the plaintiff and defendant, this deponent was informed that there come an agent from the plaintiff or her son in law Mr Hanmer to bring him to Pentrepant, and he hath not kept house since that time in Llanvyllin, Powell in August last told this deponent that he had formerly seen apparitions in the shape of women.

Evidence of Robert Morris of Hemoachey co Denbigh gentleman aged 54

He has known plaintigg and defendant these 40 years or thereabouts and believes them to be first cousins

He heard it reported by Edward Morris of Henwachey that Mr James Phillipes did say and confess unto the said Edward Maurice that the said Mr Phillips did put away his wife because she was too familiar with Mr Edward Morris of Penybont

Morris Thomas the ooke told this deponent that he was forced by Edward Morris of Penybont to go before the deputy lieutenants for the County of Denbigh being in King James his time and by them was sent into Ireland, because he was so familiar with the plaintiff

Evidence of Edward Powell of Kerry co Mont. gentleman aged 36

He knows the plaintiff and defendant about 14 years past and has heard that they are first cousins and are each of the age of 60 years or thereabouts

He was present in a place when a lease was sealed by the plaintiff by the name of Frances Phillips widow and one Mr Andrew Phillips her son and heir apparant with her, unto the defendant upon the house in Kyllynog and some part of the lands thereunto belonging, for how many years this deponent knows not - there was a proviso in case they or any of them should come there to live themselves, then the lease to be void; he heard that the plaintiff came there to live and the lease became void. As to the date of the lease, he refers to the lease. He heard of a fine passed by the plaintiff by the name of Frances Phillips widow to Lloyd Peirce esq, of some part of her jointure. He had heard by common report of sundry persons in Presteigno and there bouts that Humphrey Vele and Richard Vale his son had become charged for steeling of heyfers and that if they had not compounded, they had been like to be indicted

He was in the house of Walter Hicholas in Aymestry about a year since and as he conceiveth, he had but a small estate and poore livelihood only, what they get by keeping of an alehouse

He knew the plaintiff and defendant for 10 years past, has heard they were first cousins and conceiveth each of them to be of the age of 60 or thereabouts

He never heard that the plaintiff and defendant did any time live and cohabit together and man and wife

He knows that Thomas Powell is an old man, hard of hearing, and by report was marrued to a woman of evil fame, that he kept an alehouse at llanvyllin, that he was run into debt and left his house and family and is gone to live with the plaintiff; this deponent was told by Powell's wife that he was troubled and haunted with evil spirits in the shape of gent and other creatures

He heard that Humphry Vale was a very poor men

He was told by Walter Nicholas then constable and by his son Raph Nicholas, that Richard Vale did steel two heyfers and that they were found under the stayers in that Richard Vale's house

He knows the plaintiff for the space of 40 years and the defendant about 25 years - he believes they were each of the age of 60 and heard they are first cousins

He did not hear that at any time they lived and cohabited together as man and wife

He never heard anything that Mr Phillips should turn the plaintiff away for any such cause

Mr Symon Thellwall and this defendant did make some journeys to Radnorahire on the behalf of the plaintiff after the decease of Mr James Phillips, but about what this deponent remembereth not

Mr Lloyd Peirce receives some rents from the plaintiffs jointure in Kyllynog to raise a portion for his grandchild, as Peirce told this deponent

About 5 years since, Thomas Powell told this deponent that the plaintiff and defendant were married but when and where this deponent was not scq kinted with.

He known Powell to be an old man, hard of hearing, that he has left his house, upon what account he known not, and lives with the plaintiff or her daughter at present

Evidence of John Roberts of Llangedwyn co Denbigh gentleman aged 30 years

He knows the defendant but not the plaintiff and believes him to be of the age of 60. He never heard that the plaintiff and defendant were morrued nor that they did live and cohabit together as man and wife

Evidence of Harry Lewis of Llengedwin co Denbigh, yeomen aged 30

He knows the defendant but not the plaintiff, and believes him to be 60 years if age, and has heard that they are first cousins. He never heard that the plaintiff and deponent did at any time live and cohabit together as non and wife. He has heard it credibly reported that the plaintiff did buy lands in the name of Frances Phillips widow

Thomas Powell is hard of hearing and reputed to be a man of no great understanding, he kept a typing house in Llanvyllin, is married to a woman of an evil fame, run into great debt and left his house and family and is gone to live with the plaintiff or her daughter and had formerly received some quantity of melt from the plaintiff, how much this deponent does not know, not upon what terms

Reignold Thomas since the execution of this Commission told this deponent that Edward Meson told him that he, Mason, had been a gentleman's servant in the night time with a candle in his hand going in his shirt to the plaintiff's chamber

He knows the defendant and has seen the plaintiff, and conceiveth the defendant to be of the age of 60. He never heard that they did live and cohabit together Thomas Powell is hard of hearing and he himself did tel this deponent that he saw visions in the shape of women, maids and other creatures and that he, Powell, was very glad that God was so pleased to punish him for his former sins

He was told by Mr William Jones, Walter Nicholes and his son, that Richard Vale did steel two heyfers from the lands of Ambrose Meredith, and they were after found in Richard Vale's house

Reignold Thomas about a fortnight since told this deponent that Ed ard Mason told him that he, Mason, saw a gentleman's man in the night time going or coming to and from the plaintiffs chamber in his shirt

He knows the defendant but not the plaintiff, and conceves the defendant to be of the age of 60

He never heard that the plaintiff and defendant at any time lived and cohabited together
