Cons: rents and covenants.

 

Lease of capital messuage called Penyrworlodd, water corn grist mill, messuage called Hen Halt, several cottages occupied with the farm, all in the parishes of Llanigon and Hay co Brecon (384 a) (William Williams) with liberty to dig limestone and convert into lime for use on the land, not for sale, and with liberty to take game but reserving power for Elizabeth and Arndell Sparkes to hunt also. Out of this lease are reserved parcels pasture called the Jack or Russells Birches in Clodock (185 a); timber, minerals with right of working them and taking turf making pits, etc. for charcoaling the wood; right to plant trees, layers, and quicksetts and sow acorns or other seeds of plants called David's coppice and in the banks or hedgerows and other proper places and of fencing them without paying any compensation, and with the right at any time during the term of taking arable land up to 5 a for making a nursery for larch and other young trees and to plant trees, layers, quicksets and to sow acorns etc. in any of the rough or common pasture land, paying such annual sum as in the opinion of 2 indifferent persons (one chosen by each side) shall be fair compensation; to hold from 2 Feb. next for 7 years. Rent for the lat 3 years £300; for the next 4 £325, clear of taxes etc. paying 2 Aug and 2 Feb; additional £20 for every acre sown with hemp, flax, rape and for every acre of meadow or pasture broken up. Covenants for payment of rents and taxes except land tax and chief rent, for maintaining the buildings, walls, hedges, gates, stiles, drains, ditches, etc. for good management of the land "according to the best and most approved rules of managing and cultivating Lands of a similar nature within the said several parishes of Llanigan and The Hay" and for using on the premises all the hay etc. muck etc. produced there; covenant that at the Michaelmas seedness preceding the expiration of the lease the tenants will not sow more than 1/3rd of the arable with winter corn and that on clean and proper clover leys of the 1st or 2nd years growth and not after turnips or any other crop, and will hay up all the clover of the 1st years growth on 1 November before the expiration and not turn into or graze it after that time; and allow the land lords or the new tenants to enter to plough up the stubbles and do any usual acts of husbandry at any time after 1 Nov. providing them with stable room for their horses and lodging room for their servants in the mssuage and buildings. They will preserve the quicksetts and hedges and in plaishing leave all young slips and saplings, plaish regularly at due seasons, not suffer the hedges to be destroyed by cattle, not lop trees but preserve all timber and fruit trees. They covenant to residue in the principal messuage and not permit it to be unoccupied. The landlords covenant to put the property except the mill but including gates etc. in proper repair first, and after to allow timber in the rough for repairs. The tenants after the expiration of the lease shall have room in the outbuildings and fold and a piece of ground called the feeding ground for thrashing corn etc. till 1 May next provided they leave the straw. Proviso in case rent unpaid 21 days, for reentry.

 

Covenant between the tenants that Edward Farr shall be entitled exclusively to all benefit and advantage from this demise, Mary Pugh having joined as surety for payment of rent and performance of covenants.
