Whereby, having recited:- firstly T. Hayes' seisin at death of premises described as in PA 353/5/2 which he bequeathed to Elizabeth his daughter, now wife of Robert Mallabone (of Leamington Priors, Warws., gent.); secondly, T. Hayes' death on 3rd. Mar., 1823 (probate being granted at Lichfield on 11th. Apr., 1823); thirdly, his widow Mary's death on 12th. Aug., 1824; fourthly, the death of his son Joseph (a bachelor) on 21st. Mar., 1840, entitling Thomas' daughter Elizabeth to a moiety of her father's estate; fifthly, the details of PA 353/5/9 with issue Robert Hayes Mallabone (described in 1877 in the terms of PA 353/5/21), John Mallabone, James Mallabone (described in 1877 as of Kenilworth, Warws., farmer), Mary Elizabeth Hayes Button (described in 1877 as in PA 353/5/21), Sarah Frances Mallabone and Mary Ann Eustace (described as in PA 353/5/21); sixthly, the details of PA 353/5/14; seventhly, the details of PA 353/5/13; eighthly, the marriage of M.A. Mallabone with John Mallabone Eustace (in 1877 described as in PA 353/5/21) on 11th. Apr., 1871; ninthly, PA 353/5/7; tenthly, PA 353/5/8; eleventhly, John Ward's death (relevant to PA 353/5/5) on 2nd. July, 1824; twelfthly, William [I] Gilbert's death (relevant to PA 353/5/5) on 29th. May, 1839 intestate, leaving his son William /II/ his heir; thirteenthly, W. [II] Gilbert's death intestate on 10th. Nov., 1870, leaving William /III/ Gilbert (in 1877 of Clifford Chambers, Stratford-upon-Avon, Warws., farmer) his heir; fourteenthly, the agreement of James Sibley Whittem (of Coventry, esq.) with R. and E. Mallabone for the purchase of E. Mallabone's noiety of the premises for £1,500, and with them and with R.H. Mallabone, James Mallabone, J.C. and M.E.H. Button, and J.M. and M.A. Eustace for the other moiety for a like sum; fifteenthly, PA 353/5/20: therefore, in consideration of £1,500 (paid by J.S. Whittem to William Linney (of Bedworth, Warws., ironmonger), James Mallabone and J.C. Button), of £1,500 (paid by J.S. Whittem to R. and E. Mallabone), of 10/- (paid by J.S. Whittem to Linney et al and R. and E. Mallabone, as trustees of one moiety) and of 10/- (paid by J.S. Whittem to R. and E. Mallabone and to R.H. and James Mallabone, the Buttons and the Eustaces), W. /III/ Gilbert, Linney et al, R. and E. Mallabone, and R.H. Mallabone et al release to J.S. Whittem the premises described in PA 353/5/2 (and subject to the annuity therein-detailed) as shown on a plan endorsed on the innermost skin of this deed in red.

 

14th. Oct., 1877. Margination that M.A. Eustace produced the deed, and acknowledged it to be hers, before commissioners.
