Whereby, upon the petition of Robert Mallabone (described as in PA 353/5/19) Elizabeth his wife (by John Bernard Banks of 6, Henrietta St., Covent Garden, Mdx., gent.), Robert Hayes Mallabone (of Plano, Colin County, Texas, U.S.A., farmer), James Mallabone (of Redford Manor House, Kenilworth, Warws., farmer), John Claxton Button (address as PA 353/5/13 but termed "gent."), Mary Elizabeth Hayes his wife (by J.D. Banks), John Mallabone Eustace (as in PA 353/5/8, also M.A.) and Mary Ann his wife (by J.D. Banks) preferred (on 11th. Jan., 1877) to the High Court on behalf of William [III] Gilbert, respondent, there were read PA 353/5/5, 7 and 8, a deed dated 5th. Aug., 1876, and an affidavit (28th. Feb., 1877) of non-application to either House of Parliament, together with 16 exhibits (including William [I] Gilbert's death-certificate and John Ward's burial-certificate, which latter referred to orders (appointing Charles Oldham to examine Robert Mallabone's wife Elizabeth, John Edward Betts to examine M.E.H. Button and M.A. Eustace) now accomplished): PA 353/5/5 authorized sale of a moiety of the "Red Lion", and the court hereby directs that an agreement for sale (5th. Aug., 1876) be effected which vested the moiety in William Linney, James Mallabone and J.C. Button (as trustees of T. Hayes' will) in substitution for William [I] Gilbert and John Ward (his deceased executors), and that the £1,500 purchase money be paid to the trustees and invested in 3% consolidated stock.
