Description:

Whereby, having recited:- firstly, a principal indenture of mortgage, dated 12th. April, 1911 (made between the company of the first, and Lord Rotherham and Robert Goulay of the second, parts); secondly, an indenture dated 4th. Dec., 1916 (made between the company of the first, and Lord Rotherham (as Rt. Hon. William Henry Holland, Baron Rotherham) of the second, Robert Duncan (in 1921 described as of Dalchonzie, Comrie, Perth, esq.) of the third, and Rotherham and Duncan of the fourth, part) appointing Duncan as trustee of the mortgage in place of Gourlay; thirdly, an indenture dated 24th. Jan., 1918 (made between the company of the first, Rotherham of the second, (Sir) Christopher Robert Lighton (in 1921 described as of Lilly Court, Hereford, Herefs.) of the third, and Duncan and Lighton of the fourth, part) appointing Lighton as trustee in place of Rotherham; fourthly, that the Warws. Coal Co. Ltd. (described as in 353/18/1) has agreed to sell the hereditaments (with reservations) for £162/15/-; and fifthly, that Duncan and Lighton have joined in the transaction as debenture trustees: therefore, in consideration of £162/15/- paid by the Society (the Lockhurst Lane Co-operative, described as in 353/18/1) to the trustees, Duncan and Lighton, and the company, release to the society lands as in 353/18/3 (reserving mineral rights to the other parties), freed from the recited indentures' terms: the society covenants to erect a fence (as detailed in 353/18/1) and to submit permanent-building plans to the trustees, who acknowledge the society's right to production of scheduled documents also relating to other lands mentioned in the 1911 deed, for which the company will give a statutory undertaking.
