Description:

Whereby, having recited:- firstly, that by a lease and release (30th.-31st. Mar., 1840) the hereditaments hereinafter described had been mortgaged to Thomas Halford (in 1845 described as of Alderminster, Worcs., gent.) for £1,150 plus £5% p.a. interest; secondly, that by his will (28th. Apr., 1839) John Clark devised his property to his wife Elizabeth (subject to £500 owing on a mortgage), his son Thomas and Thomas Jones being appointed executors; thirdly, that by a codicil (14th. Apr., 1840) which stated that his Coventry and Warw. houses were (by a further charge) still mortgaged for £1,150 whereof £600 was laid upon E. Clark's Coventry premises; fourthly, that J. Clark died on 5th. Oct., 1840, his will and codicil being proved at Canterbury on 10th. Dec., 1840; fifthly, that the £1,150 principal alone remained due; sixthly, that the relevant Coventry buildings (with others) were auctioned on 22nd. Nov., [1843] to Robert Mallabone (in 1845 described as of Nuneaton Fields, Warws., farmer) for £100; seventhly, that Halford had received from other Coventry lands £340 which with R. Mallabone's £100 totalled £450 for part-discharge of the mortgage; eighthly, that William Lovatt (of Coventry, carpenter) bought, at the same auction, estate worth more than that under review (R. Mallabone's and Lovatt's hereditaments being tabulated in the first schedule hereof); ninthly, that the title deeds mentioned in the second schedule relate to other mortgaged tenements as well as to this property: therefore in consideration of £100 (paid by R. Mallabone (at the request of Elizabeth Clark of Coventry, widow) to Halford and of 5/- (paid by R. Mallabone to E. Clark), Halford and E. Clark convey to R. Mallabone a tenement adjoining the "Red Lion", Greyfriars Lane, to the use of John Whittem for R. Mallabone's life; any future assignee of the Warw. lands' mortgage must be joined with Halford in a covenant to produce any deeds relevant to the hereby-sold premises which may aid the purchaser's title; E. Clark has good right to dispose of the property notwithstanding anything done by her, Joseph and Mary Shearsby, or her husband.

 

First Schedule: four deeds (28th. Sept., 1836 - 31st. Mar., 1840).

 

Second Schedule: nine deeds (16th. June, 1790 - 12th. Mar., 1833).
