Description:

Whereby, having recited: firstly, PA 353/1/40, secondly, the mortgaging (on 3rd. Mar., 1879), in consideration of £2,000 by Hariot Tomlinson (of Coventry, widow) to Joseph Edge Banks (of Coventry, currier) of property with £4/10/-% p.a. interest, redeemable on 3rd. Sept., [1879]; thirdly, a further charge made between the same parties on 9th. May, 1881, in consideration of £1,000; fourthly the devise by H. Tomlinson on 18th. Aug., 1884 of his realty to Henry Thomas Tomlinson (in 1885 described as of Nuneaton, Warws., surgeon) and Edwin Peacock in trust for sale; fifthly, H. Tomlinson's death (31st. Aug., 1884) with proof of will (at Birmingham, 3rd. Feb., 1885); sixthly, the auction by the trustees (on behalf of Hariot Tomlinson) of the premises on 5th. May, 1885, the relevant part forming lot 1, to Thomas Beech (of Coventry, maltster) for £1,000; seventhly, that the £3,000 - total principals and their interests remained due; eighthly, that the £1,000 purchase-price would act as discharge for Banks: therefore, in consideration of £1,000 paid by Beech (by the trustees' appointment), Banks releases (as do the trustees on behalf of Hariot, H. Tomlinson's widow) land fronting Fleet St. for 17 ft., 150 sq. yd. in area (part of the 280 sq. yd. detailed in PA 353/1/23's fifth recital), bounded east by E.G. Doggett's heriditaments, west by those sold by the trustees to Jane Hitchins at the aforesaid auction, north by Fleet St., south by Thomas Mills' property; also the "George IV" (with its entry which is known as Court 5), 16, Fleet St, subject to the use by Hitchins and Beech of an ashpit at the conveyed premises' southwestern corner, to Hitchins' right of passage from the house over the yard, and to PA 353/1/31's right of passage for Doggett and Mills. Declaration by Beech that he was a bachelor on 1st. Jan., 1834. Beech agrees with Hitchins that on 25th. Mar., 1887, he will divide the premises (as shown by an endorsed plan) through the erection of a nine-inch brick wall between their cellars.
