Abstracts as follows:

 

(I)Indenture of 30 Jun 1846 between Timothy Nugent Macnamara, then late of Chichester (Sussex) but then of Lancing, esq., Lieutenant in R.N., and Michael Clayton of Lincoln's Inn, gent. (trustees, lately appointed, of the will and codicil of John Pedley then late of Caddington Hill (Herts.), esq.) (1), Nathaniel Clayton of Suffolk St., Pall Mall E. (Middx.), esq.

 

(2), Ann St. John of Boulogne Sur Mer (France), widow and relict of William James St. John late of the same (3), Harry Carew, esq., Paymaster in H.M. 13th Regiment of Infantry, and George Carew of Lincoln's Inn Fields, gent. (trustees by Ann St. John of the term of 98 years thereinafter created)(4) and John Clayton of Newcastle Upon Tyne, esq., and William Strickland Cookson of Lincoln's Inn, gent., (trustees named by (1) of the term of 200 years thereinafter created (5)) being a release from (1) to (2) of the freehold estates* late belonging to John Pedley, deceased (and by his will devised to William Lee and Christopher Hodgson and being part of estate in a Release of 18 Sep 1840 conveyed and assured to (1)).

 

Habendum: to (2) and his heirs (part being subject to trusts in an Indenture of 16 Feb 1836) to several declared uses and trusts including uses to (4) for 98 years (from 22 July 1838) if (3) should so long live to receive an annuity of £300; to WL for life, an annuity of £500; and to (5) for 200 years (from the day of the death of JP) settling the estate upon uses and trusts affecting the Macnamara family.

 

(II)Indenture of 16 Mar 1892 between Anne Mary Baroness d'Adelsward of St. Margarets, Frances Rd., Windsor (Berks.), widow (1), Arthur Macnamara of Billington Manor, esq. (2) and Herbert Pennington of 64 Lincoln's Inn Fields (3) witnessing (1)'s barring her estate tail in remainder in an undivided moiety of the Pedley estate (as devised in the will of John Pedley, dated 19 Aug 1835, who died 22 July 1838, settled as in (I) and then stood limited to the use of (2) for life, remainder to Trustees in trust to preserve contingent remainders (subject to a rent charge of £500 in favour of Lady Sophia Eliza Macnamara, wife of (2), for her jointure if she survives him) and several remainders and cross remainders over (entailing the estate) including uses in favour of John Macnamara (twin brother of (2)), and (1) and her sister Elizabeth de Rotalier as tenants in common in tail).

 

Recites that (2) was then aged 63 and had not had issue, that JM was of the same age and had one son (Arthur Macnamara) who attained the age of 21 years on 24 Apr 1882 and died 16 Aug 1890 a bachelor.

 

Schedules the land* (recording tenant, name of property, parish, and acreage) which includes as follows:

 

Caddington: Slip End Brickyard, Grove Farm, part of Chaul End Farm, Lower Woodside Farm, Blows Downs Lime and Whiting Works

 

Eaton Bray: the manor of Eyton als. Eaton Bray with its members in Eaton Bray, Whipsnade and Totternhoe, Park Farm, Moor End Farm, The Rye & Old Ley Farms, Old Abbey House and Garden, Yew Tree and Icknield Way Farms, Valence End Farm, Camp Farm, Moor End Mill, and Watercress stream at Valence EnD

 

Humbershoe: The Manor Farm

 

Whipsnade: land at Deadmonsey, Hill Farm, Dell Farm, Short rove Brickyard Farm, Short Grove Manor Farm (part Totternhoe), Houchens End Garden.

 

Lands at Flamstead, Caddington, Kensworth (in Herts.) and Limbury and Studham in Beds.

 

Total area: 3668a. 2r. 1p.

 

(III)Conveyance of 17 Mar 1892 from AMBd'A to AM of her estate right and interest in fee in remainder in the settled estate in (II) for £3738 (or ? £3864).

 

Habendum: to AM in fee subject to scheduled charges and incumbrances on portions of the land subject to the Pedley will and settlement viz. 1135a. 2r. 17p. in Eaton Bray (mortgaged 5 Mar 1863 to secure £5675 with interest at £4% p.a.), Grove Farm at Caddington and Hill Farm at Whipsnade (Land Commissioners' Charges of 26 Mar 1885) and various farms forming part of the estate (Land Commissioners' Charge of 15 April 1886).

 

(IV)Mortgage dated 17 Mar 1892 from AM to the Estate Trustees (named) of the Legal and General Life Assurance Society of the d'Adelsward undivided moiety in fee simple in remainder estate to secure £11430 with interest at £5% p.a. (in consideration of £3864 paid to AM by the Estate Trustees).

 

(V)Deaths of Elizabeth Comtesse de Rotalier, widow, leaving an only son Charles Helion Dieudonne Comte de Rotalier, on 6 Nov 1901; AM on 11 Feb 1906; and JM, widower, 18 Jan 1913.

 

(VI)Act of the LGLAJ, dated 16 Apr 1878, related Memorial (30 Jun 1911) and enrolled Declaration (30 June 1911), and Court Order of 26 Mar 1915 Society liberty to exercise power of sale vested in them in (IV).

 

(VII)Conveyance and Assignment (being a Disentailoment) dated 21 Oct 1915 from CHDCdeR par vincelles de Jura to Frederick Toutmin Leeming of 64 Lincoln's Inn Fields, solicitor, of his undivided moiety in tail in remainder in the above estate.
